A 69-year-old grandmother, Myriam Hoyos de Baldrich, was struck by a subway train in Manhattan in 2022, sustaining a severe head injury. Even though she had clues to her identity in her pocket and her family had filed a missing vulnerable adult report, the hospital treated her as a Jane Doe, and harvested her organs. The US Uniform Anatomical Gift Act states that: 1 if you are incapacitated, and 2 your family is not “reasonably available,” and 3 there is no documented evidence of your choice not to donate, 4 the administrator of the hospital shall donate your body, organs, and tissues on your behalf. So, doctors at NYU Langone Medical Center removed Hoyos de Baldrich’s organs without her family’s knowledge or consent. Hoyos de Baldrich's family and friends said she was never a registered organ donor and opposed the practice on religious grounds. The family has filed a lawsuit, pointing out that vulnerable people are being victimized, and that the interests of Organ Procurement Organizations and hospitals should not supersede the rights of patients and families. “Being in New York City, you can easily leave your ID at home — you go for a quick run, you go to the store and God forbid something happens, an accident happens,” Hoyos de Baldrich’s niece, Stephanie Echeverria told Newsweek. “And you get taken to the hospital. Do you now become hospital property just because they couldn’t identify you? It’s horrible. It’s horrific. I don’t even have the words to describe what we’ve endured.”




In Texas a hospital administrator or a district court judge can make you an organ donor without your permission. When I tried to change this, the director of the largest OPO came to my office and yelled at me: “It doesn’t matter what their wishes are, they’re dead, OK?!! We’re either going to put them in the ground or take their organs and then put them in the ground!!” Of course my bill did not pass, it never stood a chance, despite strong support from @TXRightToLife. The lobby for this and the financial entanglements are strong. But maybe it’s time to try again?
