GoFundMe created 5,000+ fundraising pages for Alaska nonprofits without their consent—a violation of Alaska law. Leaving aside the irony given how some user-created pages have reportedly been restricted, a platform raising money in a charity’s name without permission is unacceptable. GFM and other platforms did this to over 1 million nonprofits outside Alaska, and we’d welcome other States joining the effort to push back.

Giving to charity—whether it’s time, treasure, or talent—can be one of the most noble things a person does. Alaskans are generous people. But generosity depends on trust. GoFundMe and similar platforms used nonprofits’ good names to solicit donations without coordinating with the organizations actually doing the charitable work. That means some Alaskans may have donated thinking they were supporting a specific charity, when the charity never authorized the page and may never have received the donation—or may have received less than donors intended because of fees. Alaska law is clear: if you’re going to raise money in a charity’s name, you must first get the charity’s consent. Proud to amplify @SenDanSullivan’s announcement on Judge Aaron Peterson’s confirmation — and to salute all three of our Department of Law lawyers who’ve just been appointed to the bench: Two were appointed by the Governor — Chief AAG RuthAnne Beach to the Court of Appeals and Senior AAG John Haley to the Anchorage District Court — and one, Senior AAG Aaron Peterson, was confirmed yesterday by the U.S. Senate as a federal judge. Yesterday—on the first day of the legislative session—two school districts filed a lawsuit claiming the Alaska Constitution requires increased education funding. Minutes before publishing a story on the case, the @adndotcom requested a statement from the Law Department while advising that the story would run without our comments but might be edited later.  Although we had not been served with the complaint, and the story was already written, we provided a comment anyway. True to form, the ADN trimmed our quote and only included part of it. Here is our full statement: “Although we have not been served with this lawsuit and have not yet had an opportunity to review the claims, the Alaska Constitution does not prescribe a dollar amount for education funding. To the contrary, it vests the power of the purse squarely in the Legislature and the Governor. The legislative session began today. That is where education policy and funding decisions are meant to be debated and resolved. Litigating this issue would primarily enrich counsel by asking the judiciary to referee budgetary judgments the Constitution assigns to the political branches. Again, the responsible path is legislation—not litigation.”
