Think about what Lil Durk's team just pulled off. Their client demanded a speedy trial at every turn while the government continued the case four times. Then prosecutors tried to bury the original murder-for-hire case under new racketeering counts — recycled allegations they'd already walked away from once. The defense called it lipstick on a pig. The judge effectively agreed — severed the new counts, refused the delay, and questioned why the government waited over a year to bring them. Here's the tell: you don't restructure your entire case two months before trial if you're confident in the one you built. The original indictment now has to stand on its own in front of a jury on Aug 20. That's exactly the fight the defense wanted. Advantage: Durk.

Durk, Dede and Browneyez will be going to trial August 20th. Boogie’s motion to sever was denied, but his motion to continue the trial date was granted. He is not mentioned in the judge’s order as going to trial in August. Assuming it is not a typo, he will have his own trial

Well…that was a very intense hearing. Judge Fitzgerald was expressly not happy with the filing of this 3rd indictment. He plans to issue ruling by EOD on if counts 1 and 6 will be severed - (based on how the hearing went, I suspect they will)

@AbdoolBulala @youvegtMEL No judge hasn’t been biased.it will be a hard decision to sever because they added the 3rd indictment and that’s for the alleged gang enterprise so severance might be denied because of that.

Judge asked if the govmt has asked Ms. Robinson (victims mother) what she thinks about the trial being delayed because of the added charges. Govmt requested they be allowed to submit a written response to today’s hearing immediately after court - and will ask Ms Robinson her thoughts, then include what she says in the filing Judge replied, “please stop presuming I will or will not do something” (Aka - judge isn’t letting them submit the response)

When Christy O’Connor got up to give argument on Durk’s behalf, she basically said: Your honor, you’ve said it all. I don’t have much to add… (lol) She did eventually add that from the beginning Durk has requested a speedy trial & any further delay because of the govmts actions is unfair to him. They are requesting the August 20th date remain on the calendar for counts 2-4 & another trial date be set for the added counts.
