Thanks for the quick reply. Are you referring to S1095? If I'm reading it correctly, it looks like that bill creates separate abortion offenses instead of using homicide statutes. Specifically, it only allows for a misdemeanor charge against a woman who premeditates the death of her prenatal child. It also adds in duress as a positive defense for a pregnant woman. That's a problem since South Carolina states that duress is not a defense for murder (State v. Rocheville). So you're right. Aboltionists wouldn't support that bill because it's not equal protection. It doesn't even identify the intentional deaths of prenatal children as murder and then it prejudicially gives pregnant women a defense for murder that no one else has access to. I see those things as unjust/unrighteous increments. How would you define an unrighteous increment?
