The Lok Sabha has passed the Insolvency and Bankruptcy Code (Amendment) Bill, 2025,incorporating all the recommendations of the Select Committee. The Bill seeks to amend the Insolvency and Bankruptcy Code, 2016 and represents a significant step towards a comprehensive overhaul of India’s insolvency framework. The amendments aim to introduce major structural reforms, including provisions for group insolvency and cross-border insolvency, thereby aligning the Code with evolving global practices. It also expands the scope of pre-packaged insolvency resolution to cover large corporates, which was earlier limited in application. One of the key changes brought in through this Bill is the introduction of a provision allowing the assets of personal as well as corporate guarantors to be transferred to lenders as part of the insolvency resolution process. This is expected to strengthen creditor recoveries and plug existing gaps in enforcement.
