Faith-based arbitration can be voluntary and constitutionally protected—but it must never be used to bypass civil rights, due process, or equal protection. AHJC has filed an amicus brief in Joseph Miller et al. v. James V. McDonald (No. 25-133) to defend minority faiths. Founded in 2025, AHJC is a non-partisan Hindu–Jewish coalition combating Hinduphobia and antisemitism. Problem: Smith (1990) lets “neutral” laws burden religious practice, disadvantaging minority traditions. Evidence: real families forced to choose between faith and compliance. Path forward: reasonable exemptions work (e.g., Mahmoud v. Taylor; 46 states).
