I went to a police station to secure a client’s release on Friday night. I met the officer with another man who had been arrested for a KSh 210,000 debt. He was arguing loudly and was clearly distressed. He insisted he had repaid but the complainant claimed that interest was 100% interest and demanded double. There was no written agreement. When the guy realized that I’m a lawyer, he asked me to help talk to the police. I intervened and told the police to let the complainant prove his case in the civil court instead of detaining the alleged debtor. The police was so adamant but when he got some sense, he started asking for a bribe to release the guy. The ignorance exhibited by the police didn't shock me because when I was researching on this problem while in law school, I'd interviewed a few officers. Most officers don't care about using the brutal machinery of the criminal injustice system to intimidate alleged debtors. Civil debts are not criminal. Don’t be intimidated. In cases where the alleged money lending contracts are oral, they coerce the alleged debtor to sign a "Loan Repayment Agreement." The rule is that he who alleges must prove in the appropriate court. The National Police Service must address this impunity.

For the longest time Kenyans thought the Kenyan military was run professionally until June 25th 2024 happened and they realized we do not have a professional and disciplined military. They are just another bunch of police officers kept in the camps.
