@ednewtonrex Information asymmetry, indeed! This is what the EU Act aims to rebalance by requiring documentation on the training. The new AI Office (within the Commission) should come with a template for documenting the datasets used for the training. Transparency for improved relations!

A new copyright lawsuit against OpenAI. There will be many, many more of these. There's lots to unpack here, particularly as OpenAI laid out their defense to these claims yesterday in their motion to dismiss much of the NYT lawsuit. But the key takeaway for me is the total information asymmetry between AI companies and rights holders. This lawsuit is sensible, but relies on guesswork as to what OpenAI has done with copyrighted work. As it has to, because training data practices at many gen AI companies are totally hidden from the public. It is documented that gen AI companies used scraped data in the past; they still actively lobby for the practice to be legal; so it is natural to conclude they still train on scraped data. But rights holders have no way of knowing for sure what's been trained on and how the data has been handled, limiting their ability to effectively enforce their rights.
