One thing that I feel we are not perhaps as clear in explaining in teaching as we could be in law is the importance of procedure. There is a temptation to view it as practice related with minimal doctrinal input but it shapes argument in cases and consequently decisions.

It is difficult to see how a house swap could be ‘in the course of business’ as businesses are not in the habit of swapping houses. It is also interesting that the updated guidance is introduced by the word “Errata”. gov.scot/publications/s…

Agreed. There is an excellent recent chapter by Bill Swadling entitled “treehold” about the law in England and Wales. It includes some Scottish case law, but we could do with a Scottish version. bloomsbury.com/uk/modern-stud…

It is a title which I use when teaching. The Propietorship Section is odd in that both the Secretary of State and the Scottish Ministers are mentioned. I assume the latter are unregistered holders under the devolution legislation but have not completed title by registration.
