Recent #corruption allegations involving multiple prosecutors have once again drawn attention to the troubled state of #Bangladesh’s International Crimes Tribunal (ICTBD). While these scandals may be the latest flashpoint, they are far from isolated incidents. Since its reconstitution under the Yunus-led Interim Govt, the tribunal has faced sustained criticism over its jurisdiction, impartiality, prosecutorial conduct, and adherence to due process. Jurisdictional Overreach The ICTBD was established under the International Crimes (Tribunals) Act, 1973, with a narrowly defined mandate: to prosecute individuals responsible for genocide, war crimes, and crimes against humanity committed during the 1971 Liberation War. Its purpose was never to adjudicate contemporary criminal allegations.  Judicial Independence and Capacity From its outset, the ICTBD’s credibility has been undermined by concerns regarding the independence and qualifications of its judiciary. Several judges appointed to the ICTBD have had overt political affiliations, casting doubt on their impartiality. For instance, one judge, Shafiul Alam Mahmud, has been associated with the BNP. More broadly, none of the appointed judges possessed prior experience in adjudicating international crimes, and at least one reportedly lacked any judicial experience whatsoever. Prosecutorial Bias and Corruption Allegations Concerns about bias extend beyond the bench to the prosecution. The composition of the prosecutorial team has been widely criticized for its political affiliations. Former Chief Prosecutor Tajul Islam had longstanding ties to #JamaatEIslami and had previously defended several of its leaders before the same tribunal. Other prosecutors have similarly been linked to partisan political activities, with Gazi Monowar Hossain Tamim engaging in Jamaat’s political activities whilst being a prosecutor, while Saimum Reza Takulder was a member of BNP’s ICT Forum.  These concerns have been compounded by serious corruption allegations. Reports suggest that members of the prosecution engaged in bribery and other unethical conduct, including negotiating bail arrangements in exchange for payments. Disturbingly, key evidence related to these allegations, such as CCTV footage, has reportedly gone missing, raising further questions about accountability and institutional integrity. Lack of Fair Trial Guarantees Perhaps most troubling are the apparent violations of fundamental fair trial principles. Several accused individuals, including former Prime Minister #SheikhHasina, are being tried in absentia for charges that carry the death penalty. Reports indicate that these individuals have not been formally notified of the charges against them. Compounding this issue is the lack of effective legal representation for trials in absentia. Many defendants are represented by state-appointed counsels with whom they have had no communication and to whom they have given no instructions. The quality of defense provided under these circumstances has been widely criticized as inadequate. Procedural Irregularities The tribunal’s procedural conduct has also come under scrutiny. In some cases, trials have reportedly commenced without the defense being provided essential documents, such as charge framing orders. Additionally, the tribunal has deviated from its own rules regarding pre-trial detention for multipe, accused. Taken together, these issues paint a troubling picture of an institution struggling to uphold the principles of justice it was designed to serve. While the prosecution of grave int’l crimes is an essential component of accountability, it must be conducted within a framework that ensures fairness, impartiality, and adherence to the rule of law. Without proper review and significant reforms to address jurisdictional overreach, political bias, corruption, and procedural deficiencies, the credibility of the ICTBD will remain in question, both domestically and internationally. _

Bangladesh Awami League
The @UN warns that banning the Bangladesh Awami League could breach international law. Under the International Covenant on Civil and Political Rights, basic freedoms must be protected—but this move may go too far. Concerns include: • Suppressing speech & public gatherings • Blocking participation in elections • Risks of unfair trials & mass arrests The message is clear: Accountability matters—but not at the cost of democracy.⁩ #AwamiLeague #FreedomOfSpeech #UnitedNations

Legal concerns are rising in Bangladesh after the decision to ban the Bangladesh Awami League based on a proposed amendment to anti-terrorism laws. The move, linked to Muhammad Yunus’s leadership, is facing criticism for allegedly bypassing due process—acting before the law was formally approved by parliament. Experts warn: ⚖️ Ordinances must become law before enforcement ⚖️ Banning a political party without judicial review raises constitutional concerns ⚖️ Skipping official gazette publication could make the decision legally vulnerable 🗳️ Critics say the move could undermine political rights, including freedom of association and fair electoral participation. With questions over judicial independence and fundamental rights growing, all eyes are now on the Bangladesh Nationalist Party. In light of this, the debate over applying Section 18 to a major political party is not merely a legal question. It is a broader test of Bangladesh’s commitment to justice, democratic norms, and the rule of law. What is most needed in this moment is transparency, accountability, and the consistent, impartial application of legal principles. In the end, the strength of a law lies not in its severity, but in its fairness. Whether this decision will be remembered as a just and necessary action or as a controversial misuse of power will depend entirely on how faithfully those principles are upheld. eurasiareview.com/06042026-bangl… #Bangladesh

Truth Can Never Be Hidden ⏳🇧🇩 Truth can never be buried—and it never will be. Will the BNP take responsibility for undermining democracy by not repealing the unlawful ordinance? - Mohammad Ali Arafat @MAarafat71 If the Bangladesh Nationalist Party turns the unlawful ordinance issued under the government of Muhammad Yunus—through which amendments to the anti-terrorism law were used to ban the Bangladesh Awami League — into formal law, then this ban will remain in force. In doing so, the @bdbnp78 will have to take full responsibility for banning one of the country’s oldest and largest political parties. It will also have to bear the consequences of this decision in the future. It must not be forgotten that the Awami League has strong grassroots support and backing from various sections of society. Public opinion is shifting, and that shift is already becoming more intense. In this context, the Awami League will gain a stronger moral position to fight for the protection of democratic rights, the rule of law, and human rights. To safeguard the country from authoritarianism, the Awami League will continue its struggle alongside the people of the nation. #Bangladesh #Democracy
