The industry narrative is collapsing. Ohio’s kratom scheduling changes officially took effect on 5/19, scheduling virtually all kratom products except raw vegetative leaf — and a separate rule to schedule kratom in its natural vegetative state is still advancing. In Montana, lawmakers held a hearing today on a proposed kratom regulatory approach — but after hearing testimony, the conversation shifted so dramatically that a motion to move forward with drafting a ban bill was introduced and approved. Hanover, Massachusetts banned all kratom sales today. Sterling Heights, Michigan banned all kratom sales today. It’s only Tuesday…. For years the industry told everyone “regulation solves everything.” But lawmakers and local officials are finally realizing the core problem isn’t labels, packaging, or age gates — it’s the pharmacology. You cannot market a substance as strong enough to replace morphine, heroin, or fentanyl and simultaneously pretend it belongs next to energy drinks and supplements. This week alone showed something important: the conversation is changing rapidly. Public officials are no longer blindly accepting the “natural = safe” sales pitch. Science and reality are catching up to the propaganda.

Watching states crack down on kratom while pretending the synthetic 7-OH industry had nothing to do with it is one of the most dishonest narratives in this entire space. Natural kratom leaf existed in the U.S. market for decades under the existing DSHEA and FD&C Act framework. Then a new wave of companies showed up bypassing virtually every safeguard the dietary supplement industry is supposed to follow — selling ultra-concentrated, chemically manipulated alkaloid products in gas stations, wrapped in candy branding, cartoon packaging, and “legal high” marketing tactics. And now suddenly regulators, legislators, poison centers, and the media are paying attention? Of course they are. The synthetic 7-OH crowd didn’t “save kratom.” They handed prohibitionists the ammunition they’ve wanted for years. You cannot spend years pushing highly concentrated psychoactive products with reckless dosing, zero long-term safety data, questionable manufacturing practices, no meaningful NDIN pathway, and marketing that looks indistinguishable from vape-shop narcotic culture — then act shocked when lawmakers start scrutinizing the entire category. What’s even more insulting is the PR pivot happening now: The same people who spent years separating themselves from traditional kratom are suddenly screaming “save the whole plant” because they know their business model collapses the second regulators start distinguishing natural kratom from synthetic alkaloid products. This isn’t consumer advocacy. It’s narrative control. The compliant side of the industry has been operating under 21 CFR Part 111, food safety plans, identity testing, traceability, adverse event procedures, GMPs, and DSHEA positioning while warning for YEARS that the synthetic alkaloid gold rush would trigger backlash against everyone. And that warning was correct. Consumers deserve access to natural kratom products manufactured responsibly by legitimate companies — not a chemically amplified arms race masquerading as “plant medicine” while being sold next to energy shots and nicotine vapes at gas stations. The extra scrutiny didn’t come from nowhere. It came from an industry segment that ignored every lesson the supplement industry learned over the last 30 years and thought short-term cash grabs were more important than long-term survivability. Now the rest of the kratom industry is paying the price for their recklessness.

MarkWayne Mullins is behind the kids getting addicted to Feel Free, which is now commonly referred to as gas station heroin. He is making sure that the FDA stays away from his investment in the kratom company, Botanic Tonics, which he delayed disclosing he was even invested in. Now they’re also making donations in the millions to RFK Jr to ensure that they stay legal even though kids are becoming addicts because of it. They’re pushing this stuff to college athletes. Mullins appears to be protecting them from DOJ investigations too. ⚖️ The investigation was dropped after they donated millions to MAGA PACs.

The Ohio Board of Pharmacy is creating one of the most legally contradictory situations I’ve seen in the dietary supplement industry. Natural kratom leaf products are sold nationwide under federal dietary supplement law established by DSHEA and regulated through: • FDCA • DSHEA • 21 CFR Part 111 • 21 CFR Part 117 • 21 CFR 190.6 Yet Ohio regulators are effectively demanding retailers ignore or override federal dietary supplement law through state-level administrative action. So which law are retailers supposed to follow? Federal law? Or politically motivated rulemaking from unelected regulators? Even worse, Ohio’s public guidance has been inconsistent and confusing, causing compliant retailers to pull lawful products entirely while black-market operators continue unaffected. Instead of implementing: • age restrictions • testing standards • contaminant limits • labeling requirements • GMP enforcement …the Board chose regulatory chaos. This is what happens when regulators who do not understand DSHEA attempt to regulate botanical supplements like narcotics. They are not protecting consumers. They are driving compliant operators out of the market while strengthening underground sales. The solution is simple: Target synthetic and chemically manipulated compounds if warranted. But federally regulated natural kratom products manufactured under FDA dietary supplement law are an entirely different category. Ohio regulators know the difference.
