I got many queries on how the law in India protects our religious expression at work and how Hindus can use it quietly and effectively. So I have tried to compile the details here. Companies or workplaces can set dress codes. But they cannot apply them in a way that singles out our faith for unequal treatment. The Constitution doesn’t directly bind private employers, but criminal law and labour protections still apply. The truth is this that no direct law says 'u must be allowed to wear a tilak, bindi, kalawa, or sindoor.' But several laws say 'u cannot be harassed, threatened, or discriminated against for wearing them.' That’s the real shield. ➥ 𝗟𝗮𝘄: Article 25 ↳𝗪𝗵𝗮𝘁 𝗜𝘁 𝗗𝗼𝗲𝘀: Gives u the right to practice ur religion, subject to public order, morality, and health. Courts decide which practices are considered “essential.” ↳𝗛𝗼𝘄 𝘁𝗼 𝗨𝘀𝗲 𝗜𝘁: Use it as a guiding principle or moral backing, not as a direct weapon against private companies. ➥ 𝗟𝗮𝘄: BNS Section 299 ↳𝗪𝗵𝗮𝘁 𝗜𝘁 𝗗𝗼𝗲𝘀: Criminalises deliberate and malicious acts intended to outrage religious feelings, with up to 3 years imprisonment or fine. ↳𝗛𝗼𝘄 𝘁𝗼 𝗨𝘀𝗲 𝗜𝘁: If someone deliberately mocks or insults our religious symbols like Bindi/Tilak, Sindoor or Kalawa with malicious intent, we can file an FIR at the local police station. ➥ 𝗟𝗮𝘄: BNS Section 302 ↳𝗪𝗵𝗮𝘁 𝗜𝘁 𝗗𝗼𝗲𝘀: Punishes deliberate words or gestures intended to wound religious feelings, with up to 1 year imprisonment or fine. ↳𝗛𝗼𝘄 𝘁𝗼 𝗨𝘀𝗲 𝗜𝘁: Applicable in cases of targeted verbal abuse or coercive statements related to religious identity. ➥ 𝗟𝗮𝘄: POSH Act, 2013 ↳𝗪𝗵𝗮𝘁 𝗜𝘁 𝗗𝗼𝗲𝘀: Requires workplaces with 10+ employees to have an Internal Complaints Committee (ICC) to address harassment. ↳𝗛𝗼𝘄 𝘁𝗼 𝗨𝘀𝗲 𝗜𝘁: If pressure includes intimidation, blackmail, coercion, or harassment, (like the Nashik case) a POSH complaint can trigger a formal inquiry within 60 days. ➥ 𝗟𝗮𝘄: NHRC Complaint ↳𝗪𝗵𝗮𝘁 𝗜𝘁 𝗗𝗼𝗲𝘀: The National Human Rights Commission can examine violations of fundamental rights and seek responses from organisations and summon company officials. ↳𝗛𝗼𝘄 𝘁𝗼 𝗨𝘀𝗲 𝗜𝘁: File online at nhrc.nic.in. It costs nothing and creates an official record. ➥ 𝗟𝗮𝘄: Civil Suit (Section 9 CPC) ↳𝗪𝗵𝗮𝘁 𝗜𝘁 𝗗𝗼𝗲𝘀: Civil courts can hear suits of a civil nature where religious discrimination has caused tangible harm (job loss, demotion). ↳𝗛𝗼𝘄 𝘁𝗼 𝗨𝘀𝗲 𝗜𝘁: File a suit for damages if u were fired or demoted for wearing religious symbols or due to discriminatory action. Can a company or wrokplace ban all religious symbols to avoid the problem? Courts have upheld such bans in educational settings, like a college in Mumbai that banned burqas, hijabs, caps, and stoles for neutrality. The logic is that if the rule applies equally to everyone, it may not violate fundamental rights. But here's the catch i.e, disparate impact. If a neutral ban on headgear disproportionately affects one community, courts can still strike it down. The same college's rule had a disparate impact on students belonging to certain cultures, but the court still upheld it. So a truly neutral ban is legally risky but possible. It is strongly recommended to follow the 10 rule playbook shared earlier i.e, x.com/sunilsanjan/st… Based on these rules if u have solid, documented evidence, even a weak law becomes strong. Use criminal provisions like BNS 299 or 302 and file an FIR only when there is clear, deliberate, and malicious intent to wound ur religious feelings. Final blunt truth is that the law is on our side, but it's not a magic wand. U don't need to be loud. U need to be calm, consistent, and impossible to quietly erase. Document or record everything. Use the right laws at the right time. And remember, a 10,000+ year old civilization didn't survive this long by accident. Fight back with confidence, clarity, and a paper trail.
