Julius, you are absolutely right — threats against the president must always be taken seriously. But at the same time, we should also consider the source of the threat. This particular girl may never have even seen a murder weapon before, nor does she realistically have access to the president. Some threats deserve immediate high-level action, while others can be monitored closely without necessarily resorting to arrest and imprisonment. The focus should be on proportional response, not just punishment.

The fact that we’re debating whether those who threaten to kill our president should be arrested or not says a lot about how polarized this society is. What use is executive authority, which for purposes of our constitution is for the protection of the Ghanaian if the man who exercises it cannot be protected by it? We are being told today that the capacity of the persons to carry out that threat must be evaluated in the court of public opinion before such persons are arrested. People can get away with anything they say about the president but anyone no matter how feeble who threatens to harm him must lose their freedom. This subject must not be debated among sane people.

Section 75 of Act 29. Threat of Death Whoever threatens any other person with death, with intent to put that person in fear of death, is guilty of a second degree felony. “With intent to put that person in fear of death.” The President as head of state enjoys a lot of privileges and immunities including state of the art defense and security apparatus. Though there’s no express distinction in the statute, the same standard for threat of harm or threat of death to a civilian shouldn’t be applied to the President because he has every means employed by the state for protection. There are many of us even in legal practice who face threats. However obviously we wouldn’t call for the arrest of everyone who threatens us. Some are simply ignored. There are means to assess the weight of a threat. Under mere tort of assault even, the burden is to show that there was a threat and a “present capability” of carrying out the threat. Arresting people for “threats” and giving harsh bail terms is an abuse of power. It can even be broadened to restrict free speech.
