सर्वोच्च अदालतमा हाल रिक्त ३ र केही महिनामा रिक्त हुनेवाला २ गरि ५ न्यायाधीश नियुक्तिमा हालीमुहाली गर्ने सपना चकनाचुर हुनु भनेको चानचुने कुरो त हुदै होइन। नोटः माथिल्लो रोलक्रममा रहेका ३ जनाले राजिनामा दिए (दिन आवश्यक छैन भन्छु म) रिक्त हुनसक्ने सिट गणना गरिएको छैन यसमा😂😂

@NepaliTimur न्यायाधिश रहिरहन मिल्दैन नैतिकता गुमिसक्यो। नेताको भाषा न्यायाधिशले बोल्दैनन्। यस्तो ब्यक्ति न्यायाधिशको लागि अयोग्य ठहरिन्छ। त्यहाँ रहिरहँदा आउने फैसलामा त्यो सिधै reflect नहोला भनेर विश्वस्त हुने ठाउँ रहेन।

यो भाषण न्यायाधिशको नभएर नेता कार्यकर्ताको जस्तो लाग्यो! 'पख तलाई ' भने जस्तो सुनियो ।

यसपटक संवैधानिक परिषदले प्रधानन्यायाधीशमा डा. मनोजकुमार शर्मालाई सिफारिस गर्न सके कांग्रेस-एमाले तल देखि माथिसम्मै (तिनको मिडिया सहित) फत्र्याक फत्र्याक पर्नेछन्। चुनावी नतिजा भन्दा ठूलो झट्का र न्यायालयमा राजनीतिक सिण्डिकेट तोडिएको सन्देश हुनेछ यो। तर….😂😂😂

वरियता कायम कसरी भो? टपक्क टिपेर सर्वोच्च छिराउनेवेलामै प्रन्या बन्ने/बनाउने हिसाब-किताब गरी निर्धारित वरियता हैन र? सर्वोच्च प्रवेशपछि न्यायसम्पादन/नेतृत्वकुशलता आदि परीक्षण त कैले भएन/हुँदैन! न्यायाधीशै रहेका तिलप्रसादहरू पछि पर्नेगरी वरियता निर्धारण न्यायोचित थ्य‍ो?

धेरै पत्रकार, नेता, अभियन्ता, व्यापारी र आम जनताले वर्षौंदेखि एउटै कुरा भन्दै आएका छन्“विद्यार्थी र कर्मचारीतन्त्रलाई पार्टीकरणले बिगार्‍यो।” वर्षौंदेखि धेरै संगठन विद्यार्थी र कर्मचारीको हितभन्दा बढी दलका “स्लिपर सेल” बने।योग्यता भन्दा पहुँच, क्षमता भन्दा झोला र झण्डाको मूल्य बढाइयो।यसले प्रणालीप्रति नै जनताको विश्वास कमजोर बनायो। राष्ट्रिय स्वतन्त्र पार्टीले शिक्षालय र कर्मचारीतन्त्रबाट दलगत राजनीति हटाउने कुरा संगठन बनाउन नसकेर गरेको होइन। चाहने हो भने आजकै दिनमा ठूला विद्यार्थी र कर्मचारी संगठन बनाउन सक्छ।तर अर्को दलगत संगठन थप्दैमा न शिक्षाको गुणस्तर बढ्छ, न कर्मचारीको सम्मान जोगिन्छ भन्ने कुरा विगतले देखाइसकेको छ। त्यसैले अब स्पष्ट निर्णय आवश्यक थियो ,शिक्षालयमा दलको झण्डा निषेध।कर्मचारीतन्त्रमा दलको झोला निषेध।यसले अधिकार खोस्दैन, बरु पेशागत स्वतन्त्रता बलियो बनाउँछ।अब नियुक्ति, सरुवा र बढुवाको आधार दलगत निकटता होइन, विधि, क्षमता र दक्षता बन्नुपर्छ। हाम्रो प्रयास यति मात्र हो, विद्यार्थीले राजनीति सिक्दा गुरुबाट सिकून्, नेताको भीडबाट होइन।कर्मचारीले विधि खोजून्, नेताको छहारी होइन।हामी चाहन्छौं विद्यार्थीले राजनीति सिकून् तर सभ्यता, विचार र जिम्मेवारीको राजनीति; कर्मचारीले जनताको सेवा सिकून् , कुनै दलको होइन।यो कुनै पार्टीविरुद्धको लडाइँ होइन।यो प्रणाली बचाउने प्रयास हो।यो भविष्य बचाउने प्रयास हो।यो देशलाई दलगत कब्जाबाट निकालेर संस्थागत मार्गमा ल्याउने प्रयास हो।शिक्षालय र कर्मचारीतन्त्रलाई दलगत संक्रमणबाट मुक्त गर्ने यो प्रयास हो।त्यसैले तपाइहरुकै चाहना अनुरुप अध्यादेशमार्फत यी विकृतिहरू हटाएका छौ । हामीलाई सबैको साथ र विश्वासको अपेक्षा छ, तपाइको साथ चाहिएको छ, विश्वास चाहिएको छ, किनकि परिवर्तन भाषणले होइन, निर्णयले आउँछ। हामी तपाइहरुकै जनचाहना बमोजीम काम गर्न सरकार मा आएका हौ। तपाइहरु ढुक्क हुनुस, हामि जे गर्छौ आम नेपाली जनताकै हितमा गर्छौ ।

३५ बर्षदेखि थुप्रीएको Mess सफा गर्दा दुख्ने, घाउ हुने हुन्छ नै तर सम्पुर्ण पत्रकार जगत ९५% भन्दा बढिको रोइलो र असिमित रोदन देख्दा लाग्छ देश बिग्रीनमा पुराना पार्टिको भन्दा बढि उहाँहरुको हात थियो।

The Origin: Part of the "Bag Durbar" Estate** The pond (Nag Pokhari) and the land where Civil Mall stands were originally part of the massive **Bag Durbar** (Tiger Palace) complex. Built in the early 1800s by Prime Minister **Bhimsen Thapa**, it was a royal-style residence that included extensive gardens and several ponds for ritual and aesthetic purposes. ### **2. The Rana-era "Privatization"** During the Rana regime (1846–1951), the distinction between "state property" and "private property of the Ranas" was non-existent. * The Bag Durbar complex was eventually handed down to **Hari Shumsher Rana**. * When the Ranas were overthrown in 1951, the government didn't fully reclaim all palace lands. Much of the land remained in the personal names of the Rana families. * Over the decades, the sprawling Bag Durbar estate was fragmented into smaller plots and distributed among heirs. ### **3. From Ambika Rana to Ichchha Raj Tamang** The specific plot containing the pond was inherited by **Ambika Rana** (wife of Keyur Shumsher). In the late 1990s and early 2000s, this land was no longer seen as a "heritage pond" by the owners or the government, but as prime real estate. * **The Sale:** Ambika Rana sold the land to **Ichchha Raj Tamang**, the chairman of the **Civil Group**. * **The Vanishing:** Because the land was registered as "private" in the government's land records (Malpot), Tamang was able to obtain building permits. The pond was filled in, and construction of Civil Mall began around 2008. ### **4. Why didn't the Government stop it?** This is where the "grey area" of Kathmandu's urban history lies. While activists argued the pond was a public heritage site that should have been protected under the **Ancient Monuments Preservation Act**, the developers held legal land ownership certificates (*Lalpurja*). * **Kathmandu Metropolitan City (KMC):** The KMC office is actually located in the remaining part of Bag Durbar (Hari Bhawan) right behind the mall. At the time of construction, the city government was often criticized for prioritizing commercial development over heritage conservation. * **Lack of Mapping:** Many of Kathmandu’s historic ponds weren't officially recorded as "public ponds" in modern maps, allowing them to be treated as private "empty plots" for construction. ### **The Current Situation** Today, the pond is completely gone, buried under the foundation of Civil Mall. The developer, Ichchha Raj Tamang, has since faced massive legal trouble and was arrested in 2021 in connection with a multi-billion rupee cooperative scam, leading many to revisit the questionable ways his business empire (including the mall land) was built. IIt's a bitter pill for many locals because, as you saw in the photo, that area was once a beautiful open space with water and greenery—a far cry from the concrete density of Sundhara today.

काठमाडौँ उपत्यकाका नदीकिनार तथा सरकारी स्वामित्वमा रहेका जग्गामा अवाञ्छित रूपमा अतिक्रमण भएको स्पष्ट भएका क्षेत्रहरूमा नेपाल सरकारले कानुनबमोजिम अघि बढाएको व्यवस्थापन प्रक्रियाका विषयमा विभिन्न टिप्पणी तथा व्याख्या सार्वजनिक भइरहेका प्रति सरकारको ध्यानाकर्षण भएको छ। उक्त प्रक्रियालाई लिएर भूमिहीन तथा अव्यवस्थित बसोबासमा रहन बाध्य नागरिकहरूमा उठिबास हुने हो कि भन्ने आशंका उत्पन्न गराउने तथा नियोजित रूपमा त्रास फैलाउने प्रयास भइरहेको सम्बन्धमा प्राप्त सूचनालाई सरकार गम्भीरतापूर्वक लिएको छ। यसै सन्दर्भमा दीर्घकालीन समाधान कार्यान्वयनमा अवरोधका रूपमा रहेका भूमिसम्बन्धी ऐन २०२१ का केही दफाहरू वर्तमान परिस्थितिलाई दृष्टिगत गर्दै अध्यादेशमार्फत खारेज गरिएको छ। उक्त कानुनी अवरोध हटेसँगै वास्तविक भूमिहीन नागरिकहरूको डिजिटल लगत संकलन, विवरण प्रमाणीकरण तथा स्पष्ट आधारमा अभिलेख तयार गर्ने कार्य प्रारम्भ गरिएको छ। यस प्रक्रियाबाट भूमिहीन नागरिकहरूको वास्तविक अवस्था पहिचान गरी व्यवस्थित, पारदर्शी र दीगो समाधानतर्फ सरकार अघि बढिसकेको छ। ज्यान जोखिममा रही असुरक्षित स्थानमा बसोबास गरिरहेका नागरिकहरूका लागि सुरक्षित तथा व्यवस्थित स्थानान्तरणको व्यवस्था गरिनेछ। अन्य भूमिहीन नागरिकहरूको हकमा सम्बन्धित आयोगको सिफारिस र संकलित विवरणका आधारमा नेपाल सरकारले आवश्यक निर्णय गर्नेछ। नेपाल सरकार स्पष्ट गर्न चाहन्छ कि चालिएका सम्पूर्ण कदमहरू नागरिकहरूलाई हटाउने उद्देश्यले होइन, आवासको हक सुनिश्चित गर्दै समस्याको स्थायी समाधान निकाल्ने उद्देश्यले अगाडि बढाइएका हुन्। त्यसैले कुनै पनि प्रकारको भ्रममा नपर्न, अनावश्यक रूपमा नआत्तिन तथा अपुष्ट सूचना नफैलाउन सम्पूर्ण नागरिकमा अनुरोध गरिन्छ। सरकार प्रत्येक भूमिहीन नागरिकको सुरक्षित, सम्मानजनक र स्थायी आवास सुनिश्चित गर्न पूर्ण रूपमा प्रतिबद्ध रहेको जानकारी गराइन्छ। कुनै पनि नागरिक घरबारविहीन हुने अवस्था सिर्जना हुन दिइने छैन।

संवैधानिक राष्ट्रपतिलाई यस रूपमा कुनै पनि अध्यादेश फिर्ता गर्ने अधिकार छैन। अध्यादेश नियमित प्रक्रियाको विधेयक होइन। राष्ट्रपतिले यसरी नभएको अधिकारको दाबी गर्दा प्रधानमन्त्रीको कार्यकारी अधिकार प्रभावित हुन जान्छ।यस्तो उच्च तहबाट पनि संविधानको स्पष्ट रूपमा परिपालना हुँदैन भने संविधान कसरी सुरक्षित रहिरहन सक्छ?
