Sandra Birchmore’s case is heading to trial in federal court but the fight to even keep it there just got intense. A judge ruled on whether this case should exist at all and the details matter more than people realize. The most up-to-date timeline is as follows... Jan 30, 2026 → Farwell files Motion to Dismiss Feb 27, 2026 → Federal prosecutors file opposition Mar 9, 2026 → Judge DENIES the motion Here’s a clear breakdown of what each filing states so that we can get a full understanding of what will happen next. 🔸️ Farwell’s Argument: “This isn’t a valid federal case” He argued the indictment should be thrown out because it doesn’t properly establish federal jurisdiction and never shows a real likelihood that any communication would go to federal law enforcement 🔹️ Fed’s Response: The indictment uses the term “law enforcement officer” which legally means federal. They are NOT required to prove their case in the indictment. The “reasonable likelihood” standard comes later at trial, not now. 📍 Judge’s Ruling: Agreed with the Feds Said the indictment adequately alleges a federal offense. “Reasonable likelihood” is not required at the pleading stage. ✔️ Motion DENIED on this ground 🔸️ Farwell’s Argument: “The indictment is too vague” He claimed it doesn’t say who was communicating, doesn’t say what was being communicated, and doesn’t say who it was going to 🔹️ Fed’s Response: Indictments are supposed to be simple, not detailed. He’s asking for evidence, not legal sufficiency. If he wants more detail he can request a bill of particulars. 📍 Judge’s Ruling: The indictment provides enough (Date, Location, Victim, Nature of alleged crimes, and Context which is sufficient to prepare a defense ✔️ Not vague → Motion DENIED 🔸️ Farwell’s Argument: “Fowler standard is missing” He relied heavily on Fowler v. United States saying the indictment must include a “reasonable likelihood” of federal communication. 🔹️ Fed’s Response: Fowler is about what must be proven at trial and is NOT something that needs to be written into the indictment. 📍 Judge’s Ruling: Fully agrees with the government. Says Farwell is confusing trial proof with charging requirements ✔️ No need to include Fowler language 🔸️ Farwell’s Argument: “If Count One fails, everything fails” He argued the second charge (death of unborn child) depends on Count One 🔹️ Fed’s Response: Count Two is its own offense 📍 Judge’s Ruling: Count One stands and Count Two stands ✔️ Nothing dismissed Judge Casper’s ruling means that the case will move forward as planned. The Feds also recently handed over their list of discovery given to Farwell thus far and noted that he has not given them any as of yet (shocker). Moving forward, we should expect to see Farwell arguing if there was any reasonable likelihood Sandra Birchmore would have communicated with federal law enforcement and also if this case should even be in federal court at all. Now it’s up to the government to connect the dots and if they can do that, this case could carry far more weight than it ever would have at the state level.

On a day like today, St. Patrick’s Day, so much of the focus is on celebration, but at its core, Irish tradition has always been about something deeper. Irish tradition has always centered around storytelling, around making sure that a person’s life is not reduced to a moment, but remembered in full, with truth and with intention... because that is how legacies are carried. Through everything, his voice, his humor, his selflessness, and his story have not gone quiet. They continue to be felt, to be spoken about, and to be held onto by those who refuse to let them fade. In Irish belief, those who came before us do not simply disappear. There is a sense that they remain present in a different way, that they stand behind the living, and that they do not rest when something is left unresolved. Justice, in that sense, is not something temporary or convenient. It is something that is carried, pursued, and demanded until truth has its place. It is something that lives on through the people who continue to speak a name and refuse to let a story be buried. Today is about remembrance, but it is also about that quiet, steady belief that truth will stand, and that what is right will not be lost.
