South Africa has race-based laws, lots of them, that are unjust and that burden US companies. I don't particularly like the Apartheid 2.0 framing because SA's current race-based laws don't have the same draconian effects the Apartheid laws did. However, the same poison does lie at the heart of all race-based laws: the idea that race is an essential characteristic. And simply insisting, as the SA government does, that its race-based laws aren't racist because they're "empowering" is word play that doesn't change the reality. Finally, I'm all for certain sanctions on specific South African elites, but it should be done wisely and in a targeted way. Sanctioning the most virulent of them for corruption under Global Magnitsky would be just and popular with South Africans themselves who despise the theft of corruption. CAATSA sanctions might also be applicable for some depending on the exact nature of ANC and government engagements with Hamas, Iran, and Russia.

It occurs when a person makes public statements that are "really likely to damage the administration of justice" by bringing the judicial process into disrepute. The Test: Under the landmark S v Mamabolo ruling, the Constitutional Court held that while people have the right to criticise judges, statements that impeach a judge's integrity—such as accusing them of racial bias or being a "white supremacist" without a factual basis—can be criminalised to protect public confidence in the courts. Case Example: In a 2025 case, S v Mdlikiva, a person was prosecuted for making racist and disparaging remarks about a magistrate who had convicted his daughter. 2. Crimen Injuria This crime involves the unlawful and intentional impairment of the dignity of another person. Racist Insults: Using racially derogatory language or making unfounded accusations of racism against a public official can lead to a crimen injuria conviction. Precedent: High-profile cases, such as the conviction of Vicki Momberg for using the k-word against police officers, have established that racist insults are taken extremely seriously by South African courts. 3. Key Distinctions Constructive vs. Malicious: Criticism of a judgment (e.g., "The magistrate misapplied the law") is generally legal. However, personal attacks on the magistrate’s character (e.g., "The magistrate is a white supremacist") are often viewed as malicious and intended to undermine the court's authority. Truth as a Defense: If a person can prove their statement is true and in the public interest, it may serve as a defense.
