Truck drivers at Cheplaskei along the Eldoret–Nakuru highway were left seeing with their mouths wide open after discovering that the legendary “Aswito Nyama Mbichi” was not exactly what they had subscribed for. Aswito has been running a value addition business offering Sundus refreshments to long-distance truck drivers who stop by to offload pressure.
And as we all know, truck drivers don’t joke when it comes to supporting the night economy. These are loyal customers with mileage and stories. One day Mr. Rashid who is a hardworking man on transit business decides to make a quick stop at Cheplaskei to boost the night economy where he met with Aswito.
After some negotiations that would make even a lawyer proud, terms and conditions were agreed upon & Business commenced. But ladies and gentlemen, this is where things shifted from customer care to customer scare. Rashid says the last thing he remembers is him struggling to put on a condom.
Next scene,, our boy wakes up the following morning with no clothes, his Sundus lubricated, and his back office feeling like it had hosted a night vigil. And to add salt & kafirifiri to the injury, his phone worth 50K had also vanished into thin air.
Now fast forward, Rashid still trying to process life while driving his truck, he spotted Aswito casually at Salgaa stage like nothing happened, still selling sundus like a law-abiding citizen.
And as you can see, walimwengu decided to conduct a free public inquiry with no lawyer to represent the Sundus eater. Just instant justice powered by emotions and strong opinions. KRA is not playing with KTDA.
KTDA buys and sells tea leaves. Not tea. Tea ni chai. Chai ni ya kukunyua. Tea leaves ni majani ya chai. Kirui are we together?
Now,
KTDA was growing very fast. They wanted the Gulf people to taste the classical definition of proper Kenyan tea.
In 2008, they opened a branch in Dubai. Branch role, to market and sell tea in the Gulf.
In this setup, KRA was eating well. Because branches are like agents. They sell and send all profits back home.
So Dubai sold tea. Profits came back to Kenya. KTDA consolidated everything. And handed KRA a biig fat cheque.
KRA was extremely happy.
In 2014, KTDA got tired of tickling KRA.
They discovered.
- If they register a separate company in Dubai
- Gulf profits won’t be taxed in Kenya
- And Dubai tax was 0% too
So no taxes nowhere.
Directors said: Perfect. Do it. Fast!
As they are doing all this, they are unaware of one dangerous sentence sitting quietly in Kenyan tax law.
It reads:
• Any company managed and controlled from Kenya is a Kenyan resident company.
The Dubai company was registered. Life was good. Money was flowing. Zero income tax.
Next year, KRA noticed their cheque suddenly got thinner.
They asked KTDA Kenya, ndugu ni nini inaendelea hapa?
KRA got the shocking news of its life from KTDA.
- We do not have a problem paying taxes. But the Dubai branch has been upgraded to a full Dubai company. And profits are no longer coming home to be taxed.
KRA could not believe it. It returned to Times Tower. And embarked a fault finding mission.
In 2021, they found out:
- Directors of KTDA Dubai were all Kenyans
- They lived and drank tea in Kenya
- They controlled every single affair of KTDA Dubai from Kenya
Wakasema baas, nini ingine tunatafuta?
They invoked the one dangerous sentence. You remember it?
• Any company managed and controlled from Kenya is a Kenyan company.
KRA declared KTDA Dubai a Kenyan company
• Tax demanded 122M
KTDA ran to court with Dubai registration papers.
The judges questioned KRA why it wanted to harvest where Kenya did not plant?
KRA responded: My Lords, if your hen lays eggs in your neighbour’s land, is that egg yours or your neighbour’s?
Judges paused.
Then sided with KRA.
KTDA wakaabiwa walipe tax.
Case closed.
Lesson.
• Structure your offshore company properly.
• Or KRA will structure it for you.

The Kenya National Commission on Human Rights has proposed a compensation framework that looks a lot like a “silencing victims” plan for police brutality:
Victims will be paid as follows;
- Death in police cells or by their bullets - KSh 3M
- Injury from their bullets/amputation - KSh 1M
- Psychological trauma - KSh 250K
- SGBV - KSh 4M
- Abduction by them - KSh 2M
- Illegal arrest/jail - KSh 200K
But this raises a serious question:
If the government is willing to pay, why not go after the officers responsible and deliver justice?
You compensate victims, yet the perpetrators remain in the police force, free to repeat the same abuses. That’s not justice, it’s a payout system.
And what about those who never came back? The missing? The bodies at places like Kware?
This approach feels less like accountability and more like a quiet way to close cases.
Justice should come first.

Shock as Senior Police Officer Lured into a Roysambu Lodging by Over 20 Women, Assaulted and Robbed.
A senior police officer identified as Mark Maninde is currently hospitalized at Mbagathi Hospital in Nairobi County after a tragic incident that happened to him in Roysambu on Sunday night.
The officer is said to be in pain but in stable condition as doctors continue to monitor his health.
In a statement he gave while in the hospital, the officer told journalists that he was driving through a remote area in Roysambu at around 9:30PM when a young woman stopped him by the roadside.
According to him, the lady looked distressed and politely asked for help, saying she had a problem that needed attention.
