Expedited removal was authorized by Congress and upheld by the courts. The Illegal Immigration Reform and Immigrant Responsibility Act of 1996 allows immigration officers, not judges, to quickly deport certain non-citizens without a full hearing or judicial review in most cases and still satisfies minimal due process. The majority of cases still involve judges and hearings.
