A government shutdown occurs precisely because Congress has not provided (or renewed) appropriations for certain agencies. During a lapse, non-essential operations stop, and “essential” employees (like most TSA screeners) must either be furloughed or work without pay until funding is restored. They receive back pay later under the 2019 Government Employee Fair Treatment Act once appropriations are enacted—but that is not new money created by the President.0 Why an executive order cannot fix this for TSA An executive order is not legislation. It cannot appropriate new funds, override the Appropriations Clause, or waive the Antideficiency Act. Courts have repeatedly held that the President cannot unilaterally spend unappropriated money. TSA’s budget is mostly discretionary spending that requires annual appropriations. Although passengers pay aviation security fees (the “9/11 fee”), these are not mandatory spending that TSA can tap directly. The fees flow into the Treasury and are subject to congressional appropriation; federal law does not allow the agency to use them for payroll during a lapse without specific approval.45 The Trump administration has redirected or reprogrammed existing funds in some cases to pay certain DHS law-enforcement personnel (e.g., CBP, ICE, Secret Service, and TSA air marshals) during the current partial shutdown, relying on prior multi-year appropriations or specific legislative language (such as the “One Big Beautiful Bill”). However, senior administration officials have explicitly stated that this is not legally possible for regular TSA officers/screeners because of the structure of TSA’s discretionary appropriations.4 Even the military-pay precedent (where the administration repurposed DoD research-and-development funds) has been widely criticized as illegal executive overreach that violated the Appropriations Clause, the purpose statute (31 U.S.C. § 1301), and the Antideficiency Act.23 Proposals for a national-emergency declaration or other creative reprogramming to pay TSA have been floated, but legal experts and reports note they would almost certainly face immediate court challenges for lacking statutory authority.55 In short: Only Congress can appropriate the money. An executive order cannot lawfully direct TSA payroll during a funding lapse. Any attempt to do so would violate core constitutional and statutory limits on executive spending power. Historically (including during the 2018–2019 shutdown), TSA employees worked without pay until Congress acted. The same legal framework applies now.
