@Alcidesperezjr @MorosKostas No deadline to issue the opinion. Remember, it took the 3-judge panel in Snope more than a year, and they never did get it released before it was taken en banc. Hopefully it'll be soon though. If they're going to overturn it I would think they wouldn't want to dawdle.

@MorosKostas @CamEdwards Any idea on when Cheeseman v Platkin will be released for a decision? I know the en banc hearing was in October but I wasn’t sure how long it takes the 3rd circuit to release a decision once it’s made.

Oh jeeze. Can someone who knows him please tell Judge Grasz about the travelers exception laws? Because that is EXACTLY what our historical tradition says; travelers get special leeway when it comes to the right to carry. So infuriating this didn't come up at all, such a missed opportunity in the 8th Circuit. I really wish I managed to submit an amicus brief there. I realize the argument hasn't been raised, but they should remand it for new briefing and a ruling with the travelers exception history factored in. If they would just read our Gardner brief....ugh.

SB26-004 is a complicated bill, here’s some background. Colorado has high gun ownership: ~1.2 firearms per resident on average, totaling at least 7.758 million guns (likely more now). The average owner has 4-5 firearms, and about 45% of households have a gun (possibly higher when adjusted for household data). A 2024 Anschutz report says 1 in 3 Coloradans owns a gun.Despite this, Colorado ranks 25th in homicide but 33rd in firearm deaths nationally—we already have lower firearm death rates than most states. Our suicide rate is 1.5x the national average, but most suicides don't involve the types of firearms this bill targets. The real issue is crime, not lawful gun ownership. Colorado is now the 3rd most dangerous state. Since Gov. Polis took office in 2019, population grew ~4%, but murders rose 13%, violent crime 21.4%, and motor vehicle theft ~33%. Murders increased over 3x faster than population; violent crime over 5x; auto theft over 8x. Our crime rate is 27% above the national average. Yet SB26-004—expanding who can petition for Extreme Risk Protection Orders (red flag laws) to include health-care facilities, behavioral health facilities, K-12 schools, higher education institutions, and co-responders—does nothing to address crime. It targets legal gun owners and due process, while criminals ignore laws. Look no further than the Pueblo shooting exactly one year ago today, where a convicted felon wounded officers—existing laws didn't stop him, and this bill won't either. This is another obstacle to lawful self-defense in a state with rising crime. Oppose SB26-004. Protect rights, focus on real criminals.

Moving out of DC was the best decision ever. We just picked up this house for the same price as a 1500 sqr foot house in the swamp. Never looking back.
