Advocating for the constitution by helping defend laws that violate it for free
Hawaii Firearms Coalition (HIFICO)@hificoorg

Hawaiʻi Firearms Coalition recently obtained a series of documents from the Attorney General’s office through a UIPA request. These records provide insight into how the State of Hawaiʻi defended its firearm laws in federal court — including litigation that reached the United States Supreme Court. Over the next several days, we will be releasing all 14 documents in this set. Our goal is to provide transparency and help the public better understand how outside counsel was selected, how agreements were structured, and how these cases were handled behind the scenes. This is not about speculation — it is about sharing the actual records and allowing the public to see the process for themselves. 📄 Document 1: Executed Georgetown ICAP Proposal (June 23, 2023) The first document is an agreement between the State of Hawaiʻi and the Institute for Constitutional Advocacy and Protection (ICAP) at Georgetown Law. In this agreement: • ICAP agrees to represent the State as co-counsel in Wolford v. Lopez, a federal case challenging Hawaiʻi’s firearm laws • The representation is provided at no cost to the State for attorney fees • The agreement allows ICAP to assist with litigation, including appeals • Law students may also support the case under attorney supervision • The scope of work is limited specifically to this case This document shows the State beginning to assemble a team of outside legal counsel — including nationally recognized constitutional litigators — to defend its laws. We will continue releasing additional documents in the coming days, including materials related to the selection of outside counsel, contract approvals, and associated expenses. 💬 We want to hear from you: As we release each document, take a look and let us know what stands out to you. What do you think are the most important details or takeaways? Follow along as we review each document and explain what it means.

This is a pretty legendary crashout by DC. An antigun jurisdiction loses just one hardware case, and: 1. They demand its precedential value be immediately stayed even before the court decides whether to en banc it (literally no precedent or rules exists to do that!) 2. They want the en banc decision be expedited and deny Benson even a chance to reply to the petition! 3. If the court ignores this DC will be flooded with magazines and everyone will die! They are pretty much trying to bully the court into granting en banc, I think. It's an excellent preview of New Jersey's crashout if they lose in the Third Circuit.
Kostas Moros@MorosKostas

They scream in terror that California saw a surge in magazines during freedom week, and they need to prevent that. But California could point to no harm that resulted from that! And they later admitted in a different oral argument (Sanchez v. Bonta I think) that none did. The fact that DC has banned magazines over ten rounds so long is a reason to NOT stay this ruling - that constitutional violation has persisted long enough.

DC asks the court to take the case that struck down its magazine ban en banc without asking for a response, saying that the decision "causes immediate and severe risks to public safety" and "opens the floodgates for large-capacity magazines [] to surge into the District."

I emailed Benson's attorney with the timestamped link to Sanchez v. Bonta where California's lawyer admitted at oral argument that magazines over ten rounds are widely owned but rarely used in crime. Hopefully they use it in response to DC's crybaby brief.

Washington DC filed an en banc petition today in the case that struck down the city’s magazine ban (the docket doesn't currently show a downloadable document for the filing): efile.dcappeals.gov/public/caseVie…
