@carlgardner i just think it’s odd to say i wont consider things outside this courtroom before justifying a sentence that is in part designed to scare other people wishing to do the same, and to be more of a deterrent to people he explicitly notes as being undeterred by criminal law

@CarlPackman You can't really think it means the judge will not consider any surrounding aggravation (or even mitigiation!), and will simply consider the bare incident alone. In fact the content of para 45 shows this wasn't what was meant. There's no contradiction.

despite judge explicitly saying sentencing is proportionate to this incident & no other (para44), clearly it was considerate of perception of criminal law (not a crime) and made harsher ("exemplary") as a warning/deterrent. They're being made examples of judiciary.uk/wp-content/upl…

@CarlPackman Isn't it going too far to read para 44 as saying they're only being sentenced for a bare *incident* to the exclusion of any other aggravating or policy factor? The point of para 44 is simply to say the sentence isn't influenced by their conduct in court. Nothing more.
