Ruiz is being held without bail on murder charges and has pleaded not guilty
Prosecutors said the district attorney’s office is considering seeking the death penalty
This week, Ruiz’s attorneys asked the court to grant bail and place him on electronic monitoring
His defense claims the shooting was self-defense and says Ruiz had an ongoing feud with Finley that included a prior battery report
NEW: Daytona Beach Officer Punches Handcuffed Man in the Face During Open Container Arrest
27-year-old David Anderson of Tennessee was stopped shortly after midnight in Daytona Beach for drinking from an open tequila bottle in violation of the city’s open container ordinance.
Anderson handed the bottle to the officer, who emptied it.
He then allegedly threw the cork at the officer.
Bodycam video shows Anderson taken to the ground, handcuffed, tased for resisting, and punched repeatedly in the face while already restrained. Police called the punches “distractionary blows.”
The officer has been placed on administrative leave. Daytona Beach Police Chief Jakari Young called the footage “concerning” and referred it for internal investigation.
The mayor called the images “troubling.”
