Data taken directly from the Multnomah County DA website: mcda.us/index.php/data… So far I haven't found a dashboard that tracks ALL trials resulting in acquittals, but that would be helpful info too. DA overcharging is a driving factor in the unrepresented crisis. #orleg #orpol

Multnomah DA dismissals: Felony: In 2025 Q4 there were 73 issued cases dismissed*. The average time to dismissal for those 73 cases was 236 days*. Misdemeanor: In 2025 Q4 there were 202 issued cases dismissed*. The average time to dismissal for those 202 cases was 214 days*.

@rachelbusygrl Why doesn't OPDC insure/indemnify the contractors themselves? Presumably they have vetted the attorneys, offered needed training, and the attorneys meet their strict standards to be qualified to handle certain types of cases?

Requiring attorneys who are already complying with the Oregon Bar with PLF insurance - to pay for additional liability insurance to take court-appointed cases is dumb. They are already renting offices & paying healthcare & retirement while OPDS gets all of that +PERS. #orpol

The Oregon state agency for public defense has a new contract for attorneys who take court-appointed cases that requires attorneys have additional liability insurance on top of the PLF insurance the Oregon bar requires. Way to drive solo attorneys out during a crisis. #orpol

Remember this case where a DA chose to file a criminal case against a middle schooler for damaging an already damaged ceiling tile at school? And a judge found criminal intent existed? Court of Appeals reversed a similar kind of case today involving a kid acting like a kid.

@rachelbusygrl I suspect the public at large doesn't appreciate how much discretion there is in deciding whether to bring charges. They think the number of charges is almost beyond the DA's control. A crime is committed, therefore a charge is filed. In reality, though, . . .

@maxoregonian Thank you for posting this. The entire opinion is worth reading (it's only three pages). It took years for this case to resolve, with what were probably 100s of hours of resources. It should be Exhibit A that a big cause of the indigent defense crisis is overcharging.

From today’s Oregon Court of Appeals decisions, a reversal of a juvenile adjudication in Curry County, where the DA’s office prosecuted a youth for Criminal Mischief 3 for messing with a ceiling tile in a middle school bathroom. What a waste of time & money: #orleg #orpol
