@beccajiggens @ChtyCommission Wrong GR has numerous caveats/exemptions where legal fiction cannot stretch. It was always lawful to exclude males from female spaces/services/sports for the legitimate aims of safeguarding/privacy/dignity/fairness etc. Sex needs no such caveats. The law is clear where sex

@ChtyCommission The Supreme Court stated facts on 16.4.25. I’m left wondering why exactly it’s taken this long to issues this guidance or why it’s going to take until the Autumn to issue the Charities Commission Guidance. Looks to me like someone “dropped the ball” on this one!

@ChtyCommission "Charities do not need to wait for the Commission’s guidance to comply with the Act and the Code." That should say SHOULD NOT WAIT for guidance. Any charity that does so is acting unlawfully and risks legal action.

@ChtyCommission Your penultimate paragraph should have come first- Charities need to be aware that our guidance will not alter the legal principle set out by the April 2025 Supreme Court judgment, FWS v Scottish Ministers,  that ‘sex’ for the purpose of the Eq Act means ‘biological sex’
