"Colorado Democrats Declare War on Free Speech and Parents Just Hours After Supreme Court Victory for Therapists
The ink was barely dry on the U.S. Supreme Court's March 31, 2026 ruling in Chiles v. Salazar when Colorado Democrats introduced HB26-1322, a blatant power grab designed to punish counselors who refuse to rubber-stamp gender ideology on confused kids.
The high court ruled 8-1 that Colorado's ban on so-called "conversion therapy" for minors violates the First Amendment when applied to talk therapy. Justice Gorsuch made it clear: the law targets viewpoint-based speech and must face strict scrutiny. It protects the right of licensed therapists to have honest conversations instead of being forced into one-sided affirmation.
Democrats responded with revenge legislation. HB26-1322 creates an unlimited-time private right of action for anyone claiming harm from "sexual orientation or gender identity change efforts." It targets not just counselors but their supervisors, employers, and anyone who "enables" them. Plaintiffs can sue for economic damages, noneconomic damages, and exemplary damages with no statute of limitations.
Erin Lee of Protect Kids Colorado posted a video to call out the madness. Here is her full response from the video:
