It has also meant two different tax rates, and, for manufacturing breweries, holding two different licenses in order to brew styles below and above 5%. All of that gets streamlined today as the TABC officially merges "Beer" and "Ale" into a single category!

A post-prohibition era holdover, not only did this outdated law mean a 5.5% lager was technically considered an "Ale in Texas," but it meant brewers needed to comply with two different sets of rules for marketing practices, warehousing, and reporting for each category.
