This is still being investigated as to how many FBI were agitators in the crowd, let alone how many Antifa were there.

That choice tells you something about the intended audience for this enforcement action. The message is not primarily to the court. It is to the people who will vote in November and to the people who might otherwise criticize this administration and will now calculate whether a beach photo is worth the risk. Patel called it having his day in court. That framing assumes the prosecution is legitimate. Turley and the First Amendment record say otherwise.
