Remarkable. The Biden administration created out of thin air a pathway on a cell phone app for roughly 900,000 migrants from around the world to bypass the Rio Grande and enter the U.S. at ports of entry. Trump revoked their legal status on day one. A federal judge now says no.

The Constitution provided for birthright citizenship in the 14th Amendment. The Supreme Court confirmed it in the Wong Kim Ark decision in 1898. Congress adopted it in 8 U.S.C. § 1401 in 1940 and reaffirmed it in 1952. The president cannot erase it by executive fiat.


If President Trump attends the Supreme Court's oral arguments tomorrow on his birthright citizenship executive order like he says he will, he would be the first sitting president on record to do so. Presidents have avoided attendance in part to honor the separation of powers.


@getyrtrouserson @greggnunziata I agree it probably won't matter to Supreme Court decision, at least not the majority But I assume SCOTUS will refuse to overturn precedent and I'm addressing the argument some will have about Congress clarifying "subject to the jurisdiction thereof"
