Why do you spread such dishonest bullshit @joerogan? Hillary publicly conceded & congratulated Trump the morning after Election Day. She then didn’t say a word about the 2016 election for 3yrs. And Trump didn’t just “question” the election. He refused to accept the result. He lied about it. And still does. And then he committed crimes trying to overthrow the election. He’s the only president in American history to do ANY of that. And he’s trying to fuck with the elections this year. And he again won’t accept the election results this year. So yeah Rogan, you attack our elections process like that, you ARE a threat to democracy.

Defense Secretary Pete Hegseth made a false claim in his testimony to the House on Wednesday. Then he repeated it in his testimony to the Senate on Thursday. Hegseth said Wednesday: “In 2024, troops were depl… – that was Joe Biden by the way, Joe Biden –  were deployed to polling locations in 15 states." He continued, "2024 – Joe Biden – troops deployed to polling locations in 15 states. Explain that one to me.” Here’s the explanation: Hegseth’s claim isn't true. Not only were all National Guard activations for the 2024 election done by individual states rather than Biden, all 11 states that responded to my inquiries said *no troops* there were sent to polling places. Rather, they said, Guard personnel were in other locations helping with election cybersecurity, doing other behind-the-scenes support work, or not actually activated for the election after all. Another quick note about the new Comey indictment: Because Comey and his team are likely to argue for dismissal on a number of grounds, the judge will have some discretion about which issue(s) to tackle first. I'd be surprised if vindictive/selective prosecution is first.

You can’t possibly believe he admitted to an intent to kill Trump in his private comms. I agree that anything is possible, but our instincts should tell us this administration would have cited and/or leaked anything particularly damning. Evidence of a true threat just won’t be there.

You say that and neither of us know the evidence. In Blanche’s presser he mentioned the need for a taint team. That means they have emails and text messages. Contained within may be damning admissions. Admissions showing he knew what 86 meant. This is likely the differentiator between this case and other cases. We shall see.

You really got me there. But if you’d like to know how it works in the federal system, grand juries return indictments only when presented evidence by prosecutors, and those indictments are only valid if signed by prosecutors. Trump has made crystal clear that he dictates what all federal officers do, all pursuant to Article II. But let’s see them make the argument, “Trump may have been vindictive, but Todd Blanche was just applying the law without fear or favor.” Also, BTW, no one - not even grand juries - “swear out” indictments. That term is used to refer to a different type of charging instrument called a complaint. So neither Trump nor the grand jury “swore out” the indictment against Comey.

If I didn’t know better, I’d think you were auditioning for something. I’m happy to agree to disagree, but I truly hope you would have laughed this case out of your office as US Attorney. In a million years they won’t prove that he believed 86 meant “kill” rather than its other common meanings, let alone that he intended it as a threat. And on vindictiveness, I’d say live by the unitary executive sword, and die by it (that was not a threat, BTW).

Trump didn’t indict Comey. Trump didn’t charge Comey. A Grand Jury in EDNC did. And the more I learn about the case and research the likely defenses, the more righteous the case actually becomes. It’s not a case about sea shells. It’s a case about a reckless and willful disregard of a stochastic threat to the life of the President of the United States. Oh…and interstate commerce.
