A reminder to all artists... PLEASE DO NOT FOLLOW THIS ADVICE. This is how you're going to get yourself in legal troubles. Refusing a refund and attempting to revoke the ownership is absolutely theft. Remember, you might have your rights, but so does your client.🙏🏾

@NoblyOblige5796 @moyugii Yes it is. Which is why those worried about being stolen from arnt losers. Sucks someone bit off more than they could chew if it wasnt grifting. However thats no excuse to write off theft of funds from those where every cent matters.

@NathanSifuHD @DavidoftheLight Its not a product in the typical sense, you are purchasing a copy of a work. If your needs require you to have full rights. You’d have to pay for that OR commission through a Work for Hire contract. To which anything created under the WFH contract belong to the contractor.

If it's my character and I commission an artist/rigger to make a model of my character, then that character is my intellectual property and should belong to me. I should be able to do whatever I want with that character. This TOS, revoking ownership nonsense is the same stupid logic corpo's like Sony and Nintendo are trying to adopt in the videogame sphere and is the reason why people are pirating videogames. If this practice continues, using AI will not only be economically reasonable, it will also be morally justified. If buying isn't owning, then piracy isn't stealing. If commissioning isn't owning, then AI is preferable.

@Rofllcat1 @MeganeStudio102 We have personal use, commercial use, and full rights transferral. The average internet commision falls under the first unless you seek out out the other types. Personal use tier exists to have art be accessible cheaply. Buying rights is a much more expensive thing.

@Rofllcat1 @MeganeStudio102 Its that way for very important reasons. Has been this way officially since 1886. Copyright is a complicated thing. Also that just sounds to me like you mostly work under WFH contracts and that tracks for Graphic Design, however thats not how general sale works.

So I will own nothing and be happy...? And I'll issue a charge back and you'll be happy too. This will only push buyers to use AI even further. An artist TOS is just gibberish. The only thing they should include are things that they are NOT willing to draw. Nothing more.

@OldRedGrizzly @MeganeStudio102 Thats not true at all actually, by default an artist retains all right to the work and its IP and usage unless it was commissioned through a Work for Hire contract. Or purchased with a IPAA. Copyright has to be specifically signed over by the artist its not by default.

@MeganeStudio102 @Dizzy_Slime At least under US law, unless agreed upon by both parties, it is the person who commissioned the art who owns the rights to it, not the artist. So their TOS is meaningless. You cannot control what someone does with the thing they own and have full rights over.

@SonofMog @OldRedGrizzly @MeganeStudio102 Adoptables is one genre Ive always thought needs to be proper structured, and have been handled poorly 90% Ive seen it over the years. Adopt auctions or sells should always come with rights transferral. A lot do and thats why they tend to be expensive. But is handled bad.

@SofianoAmadeus @SpicyVTFollowin I dont think it should be done willy nilly or without refund myself. My main concern is how many people are buying AND Selling without educating themselves on what they are actually getting, and the actual rights behind them.

@Rofllcat1 @MeganeStudio102 Its really not non sensical if you actually read the law and regulatioms that are accepted and employed by almost all countries. They are there to protect consumer and artist alike from exploitation by corporations.

@CassieB13232482 It does happen a few of mine went this way. Its based on location, and other factors. Same as anything else deteriorating. If you live in a home without the ability to maintain a controlled climate things can rot, decay or mildew way faster than they otherwise should.

Your giving advice that will not work for most people and acting like it's good telling people see these people made it without mentioning how they did so well it's essentially like scamming them in a way. Your lying about the why they made it and not mentioning at all that while they had a pngtuber they were doing something most nobody else was doing which made them successful. So stop acting like it doesn't matter cause you know it does. Or do you just find pleasure in essentially lying to people and not giving full content. For a person who talks about being informed you sure do try to not inform people about anything

@SonicAir1375 @DavidoftheLight I never disagreed with her first model I said the exact same thing, she rode that free model for years, then purchased rights, then got a Iron Vertex Model, several, and at this point has had like 50+ models of various types cause she supports artists.
