In a deeply frustrating development, the United States' DC office argues that Benson should be granted en banc review, even though it is not defending the magazine capacity law any more. And, they are mad that other parts of the conviction were struck down. Total bullshit. This probably means en banc will be granted. A betrayal, imo.
