@DomanDragon @maxdeploy @MyNintendoNews They dmca the ones that put up a donation link, because at that point they *have* to as soon as any employee learns about it, or it can be used against them in court by a competitor to argue the game has become too generic and they aren't protecting the IP and can lose it.

@maxdeploy @MyNintendoNews Which fangames did they DMCA? Because a lot of the good ones like SMB X, Smash Bros Crusade, Mario 63, and even some of the bad ones like Isekai Mario are still up. According to Mario Fan Games Galaxy, less than 1% of Nintendo fangames actually get DMCA'ed.

@Vitha740505 @NintendoAmerica Buttons are best for a game like this IMO. The team experimented with motion controls back during the development of Fever, but they found that it got tiring for a game where inputs are constant. Plus, there's the issue of potential false positives.

@Kolma @NintendoAmerica I doubt they can for some of these if they're frame-by-frame animation. Some of them are puppet style like Homestar Runner, but the frame-by-frame stuff will likely be rendered at 24fps. Though nothing's stopping them from running at the full 60 with 24fps animations like Cuphead

@AngelusHector @Wario64 The issue is two fold. one the game needs to be installed on the internal memory instead of living on the cart and two, if the server holding the data to install the game is ever shut down, you can’t download the game.
