‼️𝐌𝐔𝐒𝐓 𝐑𝐄𝐀𝐃🔥‼️ 𝐎𝐧 𝐭𝐡𝐞 𝐄𝐅𝐅 𝐕𝐀𝐓 𝐕𝐢𝐜𝐭𝐨𝐫𝐲 On the Western Cape High Court ruling in the @Our_DA vs Minister of Finance and @Treasury_RSA case (Case No.: 2025-045530), there seems to be a lot of confusion, and possibly attempts to undermine the progress made by the @EFFSouthAfrica with regard to public finance reforms. We should perhaps, in the near future, take time to explain these issues in more detail. But here is a simple fact that no one can deny: it was the EFF that rejected the VAT increase and went to court to stop it, together with the DA. All other parties had agreed. Now, in terms of the court case, there are two things you will find consistently in most EFF budget debate speeches: 1. @ParliamentofRSA has the power to amend the proposed fiscal framework within the Money Bills Amendment Procedure. 2. The Minister of Finance’s budget is a mere proposal and may be guided by Members of Parliament on behalf of those who elected them. 3. We must use parliamentary processes to amend the proposed budget instead of saying, “we must request the National Treasury to allocate…” Now, with this in mind, the first point was to withdraw the VAT increase because, in the current economic conditions, you simply cannot implement such an increase. The second point is that a VAT increase is not an inflation adjustment and this was well argued by the EFF. It is general taxation that should only come into effect after Parliament has passed the relevant legislation. The temptation to frame this as a DA victory only, while ignoring the broader context, is simply unfortunate. But it also shows that people do not pay attention to the dynamics within the judiciary. We have a similar case in the Western Cape High Court, wherein the EFF is arguing that, like VAT, fuel levy increases are not merely inflationary adjustments. They are general taxation that cannot be amended simply by announcement while we are told the law will come later. It is representation first, then taxation. Why not fix the budget timelines and move away from the 1909 British budgeting framework so that the law is passed first and then general taxation is introduced? But because this matter is being argued by the EFF alone, they did not even want to hear the case. It had to be a fight. We must therefore prepare ourselves to pursue this matter in a different court until the National Treasury ultimately appreciates that it merely proposes, and Parliament must decide. Without an ANC majority, there is nothing to hide behind. We must all apply ourselves. I always tell Fighters: do not waste time explaining yourselves to people who truly believe that only whites can possess this level of understanding of complex public finance matters, and that as long as it is not coming from the DA or the National Treasury, it must be flawed. Be patient and instead focus on political education among ourselves and within the structures of the EFF. Not only on public finance, but on all matters concerning our sovereignty as a people: food, transport, engineering, sociology, theology and others. Do not do it for recognition. Even if you achieve everything you think will make whites recognise you and your talent, it will not happen. Let me end by reminding you of what Trevor Manuel said when he was MoF in March 1999, when there was discussion about developing a law that would allow Parliament, in line with the Constitution, to amend the budget proposed by the MoF. He said: “The executive should have the right to make policy, which should not be undermined by changes to the budget at such a late, that is, the parliamentary stage.” Effectively, he wanted Parliament to simply rubber stamp the proposed budget. True to that mission, it was only after he was no longer MoF, in 2009, that the law was finally developed to allow Parliament to amend the budget. That this law has not been used maximally in the past 17 years is unfortunate. But things are changing.

We have been consistent in saying that it is only through a resolution of Parliament that the rate of Value Added Tax (VAT) can and should be altered. We have now been vindicated, as the Western Cape High Court affirmed that the VAT rate can only be changed through a resolution of Parliament. #ThankYouEFF
