And no, the fact that Roberts was mad at Obama does not support Isgur’s position. It just highlights that this was a blatantly political decision.

In 2014 and 2015, the Court used the “shadow docket” to stop Texas’ anti-abortion restrictions from going into effect while the case was pending. The left was thrilled with the shadow docket at that point—years before this case even existed…

@whignewtons Last point. For a supposed “institutionalist” Roberts displays just absolute contempt for lower court rulings. His whole “they’re circumventing this court” ignores the dc circuit ruling. Lower court judges particularly dem appointees can just eat sh**t

@whignewtons But that’s not at all what happened in W. Va. There the only court to rule said (in a reasoned decision) that a blocking was not necessary. Roberts disagreed on policy grounds with that outcome, and decided to block in an unexplained opinion. He is just another political hack.

I’ve read the San Francisco Chronicle’s reporting and I take it seriously. What is described is indefensible. Women who come forward with accounts like this deserve to be heard with respect, not questioned or dismissed. I regret having come to his defense on social media prior to knowing all the information. I am equally as shocked and upset about what has transpired. I am withdrawing my endorsement of Congressman Swalwell, effective immediately.

@ASFleischman Interesting question is what level of deference to give trial court. Ordinary, on questions of fact, the trial court is given a ton. But here, where it is clear the trial court just blindly signed the State’s proposed order, I am not sure any deference is warranted.

@ASFleischman Trial counsel was ignorant of the law, the State relied on that mistaken ignorance at closing, and the defense of others/citizen’s arrest theory was (and this generous to the State) highly plausible. Sounds like a good IAC claim to me!

The alleged victim in this case, Kenneth Herring, blew through a red light and slammed into a semi-trailer, hard enough to make it tilt. An off-duty officer who approached him noticed that he seemed impaired. /1

I think what impresses me about this lie is that it's one she literally couldn't get away with. You think the trial judge (who shares some of the blame here) is just going to fall on his sword instead of producing evidence that he signed the exact order he was given? Amazing.

People always say you can never win at oral argument but you can lose. Which seems to ignore the possibility that your opponent will find a way to lose.

@Anthony_in_DC @ASFleischman This issue is that the jury was not instructed on the correct points of law due to trial counsel’s ignorance of the law. That’s why she deserves a new trial.

@ASFleischman Sounds to me that Herring was diabetic and in shock, which made him seem impaired. What bothers me is that Hannah did not follow officer’s instructions to just get his license plate and not confront Herring. Tough case. Not sure what I would have done if on the jury.

@AnnaBower Attorney Leslie's negligence in failing to check her citations is egregious. However, to claim she acted intentionally, that she purposely included bogus citations to defraud the court, is an assumption that is not supported by any facts that we know of.

An absolutely excruciating moment at the Georgia Supreme Court this week. Justice Peterson pressed state attorney Deborah Leslie over her citations to cases that apparently don’t exist.

Their perspectives are instrumental as the General Assembly considers youth justice policy that supports long-term safety and stability in our communities.
