@AladinKumar1 @whignewtons Reread the DC Circuit decision. They’d agreed to expedite review. There was no non-openly political basis to stay the policy. And no, the fact that Roberts was mad at Obama does not support Isgur’s position. It just highlights that this was a blatantly political decision.

@whignewtons But that’s not at all what happened in W. Va. There the only court to rule said (in a reasoned decision) that a blocking was not necessary. Roberts disagreed on policy grounds with that outcome, and decided to block in an unexplained opinion. He is just another political hack.

I’ve read the San Francisco Chronicle’s reporting and I take it seriously. What is described is indefensible. Women who come forward with accounts like this deserve to be heard with respect, not questioned or dismissed. I regret having come to his defense on social media prior to knowing all the information. I am equally as shocked and upset about what has transpired. I am withdrawing my endorsement of Congressman Swalwell, effective immediately.

@ASFleischman Interesting question is what level of deference to give trial court. Ordinary, on questions of fact, the trial court is given a ton. But here, where it is clear the trial court just blindly signed the State’s proposed order, I am not sure any deference is warranted.

@ASFleischman Trial counsel was ignorant of the law, the State relied on that mistaken ignorance at closing, and the defense of others/citizen’s arrest theory was (and this generous to the State) highly plausible. Sounds like a good IAC claim to me!

I think what impresses me about this lie is that it's one she literally couldn't get away with. You think the trial judge (who shares some of the blame here) is just going to fall on his sword instead of producing evidence that he signed the exact order he was given? Amazing.

@ASFleischman Sounds to me that Herring was diabetic and in shock, which made him seem impaired. What bothers me is that Hannah did not follow officer’s instructions to just get his license plate and not confront Herring. Tough case. Not sure what I would have done if on the jury.
