BREAKING.🚨 The Supreme Court has issued a bombshell ruling that holds the Voting Rights Act does not authorize race as a determinative factor for Congressional districts. Louisiana’s congressional map — which added a second majority-black district to comply with a lower court’s Voting Rights Act ruling — is ruled to be an unconstitutional racial gerrymander. The 6-3 decision was led by Alito, and joined by Roberts, Thomas, Gorsuch, Kavanaugh, and Barrett. Kagan, Sotomayor, and Jackson, of course, dissented. The ruling strikes down the map and significantly narrows the Court’s previous interpretation of Section 2 of the Voting Rights Act. From Justice Alito’s majority opinion: “Because the Voting Rights Act did not require Louisiana to create an additional majority-minority district, no compelling interest justified the State’s use of race in creating SB8, and that map is an unconstitutional racial gerrymander.” “Section 2 of the Voting Rights Act of 1965 … was designed to enforce the Constitution—not collide with it. Unfortunately, lower courts have sometimes applied this Court’s §2 precedents in a way that forces States to engage in the very race-based discrimination that the Constitution forbids.” “The State’s attempt to satisfy the Middle District’s ruling, although understandable, was an unconstitutional racial gerrymander…” The Court emphasized that compliance with the VRA cannot justify intentional race-based districting unless the statute actually requires it — and under the updated framework, Louisiana’s map did not. This SCOTUS ruling paves the way for red states to add at least 12 majority-Republican seats in upcoming elections.
