I'm not a lawyer & happy to be corrected but imo, the ACTP statement is v carefully worded...It says "criminal proceedings will not occur", which is a procedural/prosecutorial decision (& doesn't rule out elements of the conduct being unlawful/meeting requirements of legislation). It's not the same as saying e.g. "no crime was committed" or "the conduct was not illegal", which are more substantive legal conclusions. (contd)
