Day 4 of the OpenAI trial. Best day Elon has had in court yet, because he wasn't on the stand. Brockman took the stand and his journals are the bomb that's been hanging over this trial since before it started. His own diary entries from 2017 got subpoenaed, unsealed, and projected on the courtroom screen for the jury to read. The line that matters is one sentence. I cannot believe that we committed to non-profit if three months later we're doing b-corp then it was a lie. The judge cited that exact entry in her January ruling that sent the case to trial. Another 2017 entry came up. Financially, what will take me to $1B? The president of the nonprofit charity for safe AI development was journaling about how to personally hit a billion dollars. Brockman tried to add context. Molo cut him off and asked: it takes $30 billion to get you out of bed in the morning, but $1 billion doesn't get you out of bed in the morning? Brockman said that's not what I'm saying. The $30 billion is real. Molo asked him under oath what his stake in OpenAI is worth. Brockman: almost $30 billion. Molo dropped that figure another dozen times across two hours just to make sure the jury heard it. There's also a 2015 email where Brockman personally pledged $100,000 to OpenAI to help attract other Silicon Valley donors. Molo asked if he ever paid up. I did not end up donating, that's true. The co-founder who pledged $100K to the charity gave zero. The other co-founder is now $30 billion richer off that same charity. Brockman tried to push back. Said OpenAI is the most well-resourced nonprofit in history, $150 billion in equity. Said this is about humanity. He spoke so fast the court reporter couldn't keep up and the judge had to interrupt and tell him to slow down. Molo wasn't interested. He started calling the asset transfer a money-making machine, and at one point compared Brockman to a guy who robs a bank. The judge struck it. The jury still heard the words. The bonus content was a court filing that leaked Sunday night, showing the texts Elon sent Brockman two days before trial trying to settle. Brockman said sure, both sides drop everything. Elon's reply: by the end of this week, you and Sam will be the most hated men in America. If you insist, so it will be. OpenAI tried to enter the texts into evidence Monday morning. Judge said no, you should have brought that up while Elon was on the stand last week. The jury never saw it. Everyone else did. Sama is up the week of May 11. Whatever damage Elon did to his own case last week, Brockman spent today undoing for him.
