Many Americans have understandingly expressed concern, frustration, and opposition to how the Biden EPA, through its Technology Transitions Rule for refrigerants, was implementing the American Innovation and Manufacturing (AIM) Act to phase out hydrofluorocarbons (HFCs). The AIM Act is a federal law that requires EPA to phase down HFCs by 85% by 2036. In practice, the Biden EPA’s Technology Transitions Rule established more aggressive restrictions than required by law, resulting in higher grocery costs, reduced access to residential AC units and supplies, and far more complicated maintenance of equipment. It also hurt semiconductor manufacturing in our country. At the Trump EPA, we are taking action to fix this mess we inherited, which includes proposed flexibility on compliance deadlines while staying within the boundaries of the law. We will do EVERYTHING in our power to assist! If finalized, our proposed rule would correct what many have raised as a grave mistake by the Biden Admin. And for those who just want to directly eliminate (or amend) the federal law altogether, I’d note that would obviously require an entirely new Act of Congress. The bottom line is this: The Biden EPA Technology Transitions Rule for refrigerants is simply unworkable, and the Trump EPA is committed to fixing as much of it as permitted under the law.

FMI’s Chief Regulatory Officer and General Counsel, Stephanie Harris, participated on behalf of FMI and our members in the U.S. Environmental Protection Agency’s virtual public hearing on the proposed Technology Transitions Rule under the American Innovation and Manufacturing Act of 2020. She joined the discussion to share industry perspectives on how proposed refrigerant transitions affect food retailers and suppliers across the supply chain. A big thank you to Garrett Piklapp, President of Fareway Stores, Inc., for meeting with EPA officials to highlight the importance of additional time and common-sense reform to ensure a smooth, practical transition for the entire industry. FMI remains committed to working with regulators and members to advance practical, responsible refrigerant solutions across the food industry.

As recently promised at an event with @VP in Peachtree City, Georgia, EPA is proposing revisions to the flawed Biden EPA Technology Transitions Rule that raised commercial costs at grocery stores while reducing access to residential AC units and supplies.   Our proposed rule, if finalized, will preserve access to affordable refrigerants for all Americans by allowing companies to continue installing systems that have been manufactured or imported into the US, while not forcing Americans to replace their whole HVAC system when only part of it needs to be replaced.
 From semiconductor chips to supermarket freezers, our proposal, if finalized, would keep Americans cool and costs down. Smart policy, strong economy, and consumers first.
