Prison unique en France, la réduction des risques est l’une des priorités de l’établissement. Dispositif d’échange de seringues, pipes à crack, tests de dépistage fréquents… les équipes de l’unité sanitaire on réussi à prévenir et à maîtriser des infections telles que l’hépatite C et le VIH au sein même de la maison d’arrêt.
La prévalence des addictions parmi les personnes incarcérées est plus importante qu'en milieu ouvert. On estime qu'un tiers des personnes qui entrent en prison présentent une problématique addictive hors tabac et que la quasi-totalité continuent à consommer d'une manière ou d'une autre au sein de celle-ci. Près de 60 % des consommateurs et consommatrices de produits illicites autres que le cannabis inhaleraient, quand 30 % utiliseraient l'injection selon une étude de 2017 dans la prison de Lyon-Corbas. Dans ce contexte de pratiques de consommation à risques et d'absence de matériel de réduction des risques stérile (inhalation, injection), la prévalence du virus d'immunodéficience humaine (VIH) et des hépatites virales est 6 à 10 fois plus importante que dans la population générale.
La réalité est la suivante : on se contamine en prison en France.
Or l’équivalence des soins entre milieux fermés et milieux ouverts a été votée en 1994. La réduction des risques a été formellement inscrite comme s’appliquant en prison en 2016, même si les décrets d’application n’ont jamais été publiés. Les dispositifs et outils de réduction des risques varient donc d'un établissement à un autre, et sont la plupart du temps inexistants, aux dépens des détenus et de leur santé.
C’est donc d’un réel cynisme de la part de l’Etat quand le Ministre de la Justice assume l'usage de drogues illicites au sein des prisons françaises, sans pour autant laisser passer un décret d’application permettant de préserver la santé et les droits fondamentaux des usager•es de drogues en prisons.
