Perhaps you should read the statute, Einstein. And about 30 years of Minnesota jurisprudence. How do I know that? 30 years of criminal practice in this state.

@FishingGodMN @jpcoolican @maxnesterak Wrong. An officer needs probable cause, not reasonable articulable suspicion. PC and RAS are two different things. And nowhere in the report does the officer "detail why he believed him to be intoxicated."

You will find it to be "facts and circumstances that would make a reasonable peace officer BELIEVE that a crime has been committed." I'm done. You can lead the horse to water....

@mitchpberg The story is a lie. He was NOT tested at the station, so they have no evidence he was 'intoxicated". MN Reformer is just lying. The cops could have tested him if they thought he was carrying AND intoxicated, and they did not.

Yes. Representatives Hudson and Engen deserve due process... to determine whether they’re thrown in a cage. Whether they should serve in the legislature is properly decided through political process. They should resign. If they don’t, their colleagues should expel them.

@jpcoolican @maxnesterak If he refused he would lose his permit and be subject to a $500 civil penalty. If he tested over the legal limit, he’d also lose his permit and be subject to a criminal charge. This won’t be a good look for the WBLPD if they screwed this up.

In 2022, MN State Auditor Julie Blaha rolled her car into the ditch, spreading empty cans of White Claw all over. The DFL rapid response van swooped her up, ran interference with the media, and she won re-election just a few months later. The current leading DFL candidate to replace her, State Rep Dan Wolgamott, has had two DWIs and was still named "Minnesota Police and Peace Officer Association's Legislator of the Year." When I first met Republican State Auditor candidate Nate George at a forum in Albert Lea last fall, I asked him, "Based on the history of our current State Auditor, Julie "White Claw" Blaha, and her replacement, Boozin Dan Walgamott, how many DWIs do you have, and do you think it's enough to be a qualified State auditor?" 🧐 Nate George said he has had NONE. That's a good answer. Plus, he can count. Don't drink and drive. If you drink and need a ride, call a friend, call an Uber, or call your mom.
