JRM owns the trademark for the DEI stylized eight. RCR owns the trademark for the stylized eight that KB used. NASCAR owns all of the cup numbers. The 8 is assigned to RCR for Cup and JRM for NOAPS. Dale Jr. more than any other person out there knows what Brexton is going through now and will continue to experience as he grows up in racing. Kelley has spent the last several years watching her son and Brexton grow up together as race car drivers. Dale Jr. and Amy got married at Richard and Judy’s winery. RC has walked this road before with the 3. I don’t think any of us need to worry about how this group of people is going to navigate who uses what number if someday JRM has a Cup car and wants to use something other than 40.

Respect this decision tbh. However what if Dale Jr gets a Cup team and wants to race under his own stylized 8? I would imagine there would have to be some conversations involving all of the interested parties.
