गरिमा जी को शुक्रिया भारत बांग्लादेश के बॉर्डर समस्या का आंखों देखा हाल बताने के लिए, यह बिल्कुल सही है कि सीमा सुरक्षा 'केंद्रीय विषय' है, लेकिन जमीन 'राज्य का विषय' है। गृह मंत्रालय पैसा देता है और BSF सुरक्षा करती है, लेकिन एक इंच भी बाड़ लगाने के लिए राज्य सरकार द्वारा भूमि अधिग्रहण अनिवार्य है। यह संघीय ढांचे की वह कड़ी है जहाँ अक्सर राजनीतिक गतिरोध पैदा होता है। न्यायालय ने पश्चिम बंगाल सरकार को आदेश दिया है कि वह 31 मार्च, 2026 तक सीमावर्ती नौ जिलों में अधिग्रहित की गई सभी जमीन सीमा सुरक्षा बल को सौंप दे। कोर्ट ने स्पष्ट किया कि चुनाव प्रक्रिया, प्रशासनिक देरी या विशेष गहन पुनरीक्षण (SIR) जैसे कारणों को राष्ट्रीय सुरक्षा के दायित्वों में देरी के लिए स्वीकार नहीं किया जाएगा। सेवानिवृत्त सेना अधिकारी डॉ. सुब्रत साहा द्वारा PIL पर सुनवाई करते हुए कोर्ट ने माना कि सीमा के खुले होने से अवैध तस्करी और घुसपैठ को बढ़ावा मिल रहा है। पश्चिम बंगाल बांग्लादेश के साथ लगभग 2,216.7 किलोमीटर लंबी सीमा साझा करता है। इसमें से लगभग 569 किलोमीटर पर बाड़ लगनी बाकी है। इसमें से 112 किलोमीटर हिस्सा भौगोलिक रूप से दुर्गम (नदियां, पहाड़) होने के कारण फेंसिंग के लिए कठिन माना गया है। अगस्त 2025 तक, लगभग 378 किलोमीटर जमीन के लिए अधिग्रहण प्रक्रिया अभी भी अधूरी थी। इसमें से 148 किलोमीटर के लिए राज्य सरकार द्वारा प्रक्रिया शुरू किया जाना बाकी था। गृह मंत्रालय ने बताया कि 181.6 किलोमीटर जमीन के लिए केंद्र द्वारा राज्य को भुगतान किया जा चुका है, लेकिन जमीन अभी भी भौतिक रूप से BSF को नहीं सौंपी गई है। मुख्यमंत्री ममता बनर्जी ने फरवरी 2026 में कहा था कि उन्हें बाड़ लगाने के लिए जमीन देने में कोई आपत्ति नहीं है, लेकिन उन्होंने केंद्र से BSF के क्षेत्राधिकार को 15 किमी से बढ़ाकर 50 किमी करने के फैसले को वापस लेने की शर्त रखी थी। केंद्रीय गृह मंत्री अमित शाह ने बार-बार आरोप लगाया है कि राज्य सरकार "तुष्टीकरण की राजनीति" के कारण आवश्यक जमीन उपलब्ध नहीं करा रही है, जिससे राष्ट्रीय सुरक्षा खतरे में है, 22 अप्रैल 2026 को मुख्य न्यायाधीश सुजॉय पॉल और न्यायमूर्ति पार्थ सारथी सेन की खंडपीठ ने राज्य के भूमि एवं भूमि सुधार विभाग के संयुक्त निदेशक पर ₹25,000 का व्यक्तिगत जुर्माना लगाया। यह जुर्माना इसलिए लगाया गया क्योंकि राज्य सरकार 31 मार्च की समय सीमा बीत जाने के बावजूद जमीन हस्तांतरण को लेकर संतोषजनक हलफनामा दाखिल करने में विफल रही थी। कोर्ट ने नाराजगी जताते हुए पूछा कि जब केंद्र सरकार ने जमीन अधिग्रहण का शुल्क पहले ही चुका दिया है, तो जमीन BSF को क्यों नहीं सौंपी गई। अदालत ने राज्य सरकार को दो सप्ताह के भीतर एक विस्तृत हलफनामा दाखिल करने का निर्देश दिया है। इस मामले की अगली सुनवाई 13 मई, 2026 को निर्धारित की गई है। सीमा पर बाड़ लगाना केवल एक निर्माण कार्य नहीं, बल्कि राष्ट्र की संप्रभुता की सुरक्षा है। राज्य सरकार को यह समझना होगा कि अंतरराष्ट्रीय सीमाओं का प्रबंधन राज्य की राजनीति से ऊपर होना चाहिए। कलकत्ता उच्च न्यायालय का सख्त रुख और 13 मई 2026 की अगली सुनवाई यह तय करेगी कि पश्चिम बंगाल सरकार अब भी टालमटोल करती है या राष्ट्रीय सुरक्षा को प्राथमिकता देते हुए जमीन सौंपने की प्रक्रिया को गति देती है। अंततः, एक सुरक्षित सीमा ही भारत और बांग्लादेश दोनों के बीच शांतिपूर्ण और कानूनी संबंधों की नींव हो सकती है।
