I have my issues with the way the Marsden Fund has worked in recent years, but completely disbanding the social science and humanities funds is mind-bogglingly short sighted. There is already very little support for this work in NZ compared to Australia. beehive.govt.nz/release/marsde…

Putua is an easier case - there was a simple clerical error that led to the wrong sentence , in Fitzgerald the HC and the CA adopted probably a pretty orthodox view of the Three Strikes Act that required a very unjust result

This will be a huge case - not least of which because the SC has already signalled it will hear arguments about when SC will depart from its own decisions, but it will also require the Court to openly deal with major issues about the nature of state liability in NZ

And so Ellis J’s creative attempt to get around Chapman and its prohibition on suing the state of NZ for judicial errors failed. The way is now clear for the Supreme Court to hear directly arguments that Chapman was wrong, as it did gave leave in Putnam.
