We sound like these leaders who are supposed to follow Article 10 are from different alternate universe. These are kenyan elected by fellow Kenyans. we need to elect leaders with integrity rather than electing these these wash wash leaders, then blame the judiciary for not taming them after we give them power on the ballot.

KENYA IS FINISHED. THE SUPREME COURT HAS SOLD US CHEAP TO GOVERNMENT. THE SUPREME COURT RULED THAT ARTICLE 10 ON NATIONAL VALUES IS UNENFORCEABLE AGAINST GOVERNMENT OF KENYA. The Court of Appeal, in many cases, held previously that the principles in Article 10 are not "constitutional polemics" or "high sounding rhetoric" but are justiciable and enforceable constitutional dictates. Pandering to the whims and demands of the government in the 2023 Finance Bill case, the Supreme Court, in paragraphs 146 and 147, of its judgment delivered on 29th October 2024 shockingly states: [146] ...this court highlighted the need to avoid interpreting broad constitutional values and principles, such as those articulated in Article 10(2) of the constitution as though they were prescribed normative rules. Values and principles act AS GUIDING FRAMEWORKS, OUTLINING THE CONSIDERATIONS THAT DUTY BEARERS, SUCH AS PARLIAMENT, SHOULD TAKE INTO ACCOUNT WHEN MAKING DECISIONS. HOWEVER, THEY DO NOT DEFINE SPECIFIC DUTIES OR ACTIONS... "[147]...Courts should be careful to distinguish between values and principles on one hand, and normative rules on the other hand, to avoid overprescribing duties from principles and values which are nature open-textured...It follows that the values and principles are optimising commands that allow duty bearers to come up with suitable measures for fulfilment of the obligations that they impose, without dictating definitive or specific actions that they ought to take"
