Plenty of lawsuits that have been created over stuff like this have been dismissed for the same reason. Look up examples there are plenty.

I’m gonna be honest.
Cheating is bad, it’s terrible and it’s wrong.
But it’s also none of our business unless we’re the other person informing the one being cheated on.
It’s not our apology to accept or deny and it’s not our place to say if she should stay or shouldn’t stay.
We don’t know their full situation. Was it shitty? Yeah. But it’s over and done with and there’s nothing we or anyone can or should do about it.
The rest is up to the cheater and the person who was cheated on.
