Pitts v. USA Evidentiary Hearing Fulton Ballot Seizure Criminal Investigation Why are We Here? Its Friday morning and we are attending an unprecedented “evidentiary hearing” for a Federal Bureau of Investigation (FBI) criminal procedure in the Pitts v. USA case challenging the criminal investigation into Fulton County’s handling of the 2020 election. As an interested party who obtained the original preservation order for the ballots on January 7, 2021, I will be providing updates on our @VoterGA X account during courtroom breaks. Fulton County wants the FBI to return all election records to them before the investigation is completed and any indictments are issued. They also laughingly seek to prohibit the Department of Justice (DOJ) from using records against them in criminal prosecutions. The hearing is unnecessary because the Fulton County Petitioners have no clear standing and cannot possibly meet any one of the four-part substantive tests for the court to order return of the property. The claims involve 1st and 4thamendment constitutional rights under Rule 41.(g) criminal procedures. The Petitioners, Fulton County, Fulton County Commission and Fulton County Board of Registration and Elections have no constitutional rights because they are government agencies. The remaining Petitioners, Commission Chairman Robb Pitts and Clerk of Court, Che Alexander, are joined in their official capacities and have no Constitutional rights either because Constitutional rights are reserved for individual U.S. citizens. In spite of the law, the judge has yet to remove the agencies from the case. Clerk Alexander was coerced into joining the case after it was filed because she is the custodian of the ballots and the only one who could possibly be granted standing. Before and after agreeing to be added to the case, she repeatedly lied to the American people claiming she is a “neutral party” when she is actually the main party. As the custodian of the ballots, the Court found that Clerk Alexander has a “possessory interest”. However, there is no need for an “evidentiary hearing” since she cannot meet any one of the four-part substantive tests for return of the election records. For Fulton to gain return of the election records, the fake “neutral party” clerk would have to meet all four substantive tests established by the court in its own 2/26/26 order. Here are the tests and why Fulton fails multiple times on all counts: 1. Did the government display a “callous disregard” for the plaintiff’s constitutional rights? o The clerk in her official capacity has no constitutional rights and the DOJ adhered to normal procedures of obtaining a valid, court authorized, search warrant twice 2. Did the plaintiff have an individual interest in and need for the material? o The clerk has no individual interest because she is a party in her official capacity as custodian and she has no need for records that have been sitting in storage for years 3. Will the plaintiff be irreparably injured by denial of the return of the property? o There is no harm to the clerk or any clerk process if the FBI continues to possess the election records. She even asked a court for permission to destroy the ballots in a June 2024 hearing in our case after falsely claiming there was no room weeks after Fulton spent $30 million to acquire their new 660,000 sq ft warehouse; 4. Does the plaintiff have an adequate remedy at law for the redress of her grievance? o The clerk has no grievance because she has no constitutional rights and she will suffer no injury if the FBI continues to possess the election records. Her only grievance for harm can occur if she is indicted for criminal activity. The DOJ submitted a devastating brief on 3/20/26 outlining some of these points and so much more but a couple hours later Judge Boulee entered an order for an evidentiary hearing anyway. It seems obvious from the order that he had not read the DOJ brief since it did not really address any of the major arguments the DOJ raised. Six days later, after the court had time to digest the DOJ brief, it adopted one of the key DOJ arguments and quashed a subpoena for the FBI special agent who submitted the search warrant affidavit to testify. Given that most of Fulton’s claims are about the agent, I am not sure why we are even here but I will let you know if they explain it.

🚨🚨🚨📰Press Release Georgia Senate Strive to Pass Essential Election Security Bill ATLANTA, GA. MARCH 27, 2026 – Georgia State Senators are expected to vote Friday on HB960, a hand marked paper ballot bill that provides several features to help secure the 2026 Georgia General Election. The House bill carried by Senator Greg Dolezal, was repurposed in the Senate Ethics Committee after the original language was included in HB1215 and passed out of the Senate Judiciary Committee. The Senate version now specifies hand marked paper ballots to replace Quick Response (QR) coded ballots that are unverifiable to the voter and have been found to violate three Georgia statutes. HB960 mandates post certification recounts of key federal and state races in all types of elections to ensure correct voting system results. It also mandates that recounts in contests with under a 1% victory margin are hand counted to ensure the election is awarded to the correct candidate. Current law offers no hand recounts to verify secret voting system counts and close races are recanvassed which simply reprints previous unverifiable results. HB960 also mandates timely posting of current eligible voters lists before the election and prompt posting of current lists of voters who voted immediately after the election. These lists are essential to reconcile the number of voters who voted with the number of ballots cast. HB960 mandates ballot batch identifiers for all election ballots and activates current infrared detection that can verify ballot security paper. The batch identifiers and infrared detection will help deter fraudulent duplication of ballots that can easily be inserted into election results. Other provisions require post-election Open Records Requests for electronic copies of ballots to be provided within 30 days at no charge to the requestor. Yet another provision will transfer audit responsibilities to the State Election Board. Current law allows the Secretary of State to audit the elections it conducts. The bill eliminates that obvious conflict of interest. A primary outstanding issue is how several large counties can best supply early voting locations with different ballot styles needed in an election. Garland Favorito, co-founder of VoterGA stated: “The Georgia General Assembly is still working hard on security provisions for our elections. We are grateful to Senator Dolezal and the Georgia Senate leadership for their efforts to get these security improvements over to the House for potential final adjustments.” Based on a recent vote of SB568, a similar bill, most Senate Republicans are expected to vote for HB960 while nearly all Democrats are likely to oppose it. Trump could have done this on Day 1 and TSA agents could’ve been paid all along. But he and Republicans devised a plan that they were going to leverage airport chaos to get Democrats to cave. It was a coordinated campaign with Fox. They used TSA and travelers as political pawns.
