Now on @SSRN, my new article, Reimagining Digital Libraries. It discusses how public libraries operate in the digital space, their (rather significant) challenges, and how we might tackle them. Forthcoming at @GeorgetownLJ . Comments are very welcome. papers.ssrn.com/sol3/papers.cf…

In this blog post, I explain how SCOTUS's decision in Cox v. Sony will be mitigated, narrowed, and likely circumvented. Bottom line: despite Thomas's opinion, courts are unlikely to let service providers knowingly facilitate copyright infringement. blog.ericgoldman.org/archives/2026/…

My new work suggests SCOTUS plays a limited role in shaping copyright law, as its decisions are filtered & narrowed by repeat players. The result is a resilient & decentralized copyright system. Thoughts on the connection to Cox v. Sony coming soon. papers.ssrn.com/sol3/papers.cf…

New essay: Copyright’s Invisible Hand, now out at Cornell LR Online. By bundling high- and low-intensity uses of copyrighted works, Congress channels billions annually to libraries and cultural institutions. This important policy deserves to be preserved. papers.ssrn.com/sol3/papers.cf…

The Canadian government (again) considering enacting an Artists’ Resale Rights scheme, where artists will be paid when their works are resold. The stated goal is to support low-income artists. I joined @LawBytesPod with @mgeist to explain why this is a truly awful idea.
Michael Geist@mgeist

Canada’s plan to create a new Artists’ Resale Right may raise concerns for artists and the broader economy. Will art sales move to the US? Will the plan primarily benefit wealthy, old or dead artists? @Guy_A_Rub joins the @lawbytespod podcast to discuss. x.com/mgeist/status/…

I’ve uploaded the slide deck of my lecture last week at the Philadelphia IP Association on Copyright and AI Training. It was a fun event. (Posted on the holiday, although thankfulness for generative AI remains questionable). papers.ssrn.com/sol3/papers.cf…

Copyright law intentionally subsidizes libraries & other cultural institutions by protecting them from predatory pricing. But digital licensing is undoing it. My new essay (forthcoming @Cornell_L_Rev Online) explains what’s at stake. Check it out: papers.ssrn.com/sol3/papers.cf…

@AmericanAir Ok. But if all of this is going to start tomorrow, when are those clarification happening? I'm traveling tomorrow and on Saturday. Canceled flights is one thing. Canceling at the very last second is another.

@Guy_A_Rub We’re awaiting additional clarifying information from the FAA as we determine which flights will be impacted and what that looks like for our customers. If your flight is impacted, we'll communicate details via email.

Due to the ongoing government shutdown and nationwide air traffic control staffing shortages, the FAA has directed airlines to reduce flight schedules to maintain safe airspace operations starting Friday, Nov. 7. We expect the vast majority of customers’ travel will proceed as planned, and we will proactively reach out to customers who are impacted as schedule changes are made. As always, we encourage everyone to check their flight status via the American Airlines mobile app or aa.com.

My article, Reimagining Digital Libraries, analyzing the struggle of public libraries to adapt to the digital world, and why copyright law should adjust to tackle that new world is now out at the Georgetown Law Journal. Read it while it last.
The Georgetown Law Journal@GeorgetownLJ

In light of exemptions from copyright liability that have not adequately protected public libraries in the age of digital lending, Prof. @Guy_A_Rub of @TempleLaw argues a multifaceted approach is needed to protect the public good that libraries serve. bit.ly/glj-reimagining

@TheHerd @colincowherd I wish this was true, but you look at recruiting ranking in the last few years and you see that the SEC is still king. For the 2025 class, per 247, the top 10 have 7 SEC teams, including #1 (Texas) and #2 (UGA). They dominant the transfer portal too.

Those DMs didn't do much. After more than a day and a half, @Airbnb still can't address the issue. They just now asked for pictures. You can't be a company dealing with tourism and have a slow customer service. It's a bad combination.

Arrived in Paris yesterday. Had serious issues with my @Airbnb and couldn't sleep in the apartment. 24 hours later and @Airbnb is still transferring it from one "ambassador" (isn't that a silly title?) to another, but no solution or even serious responses.

@ProfRobAnderson D although one can probably give a better explanation. It's an offer but the option contract rule doesn't apply in this case. If I say "I will pay $200 to whoever find my lost dog" and you spent days looking for it and couldn't find it, you have no cause of action. Same here.

Here's a tough Contracts multiple-choice question that doesn't have a single completely satisfying answer. It's an interesting hypo. #1LContractsMultipleChoice Lena, a local artist, posts on a community board, "I will pay $200 for anyone who can deliver 50 custom-made clay mugs to my studio by next Saturday. First come, first served." Jill, seeing this as an opportunity, immediately orders the materials and begins crafting the mugs, spending $150 and dedicating several days to this task. She finishes by Friday and contacts Lena to deliver the mugs the next day. However, Lena had already found another supplier and told Jill she no longer needed the mugs. Which of the following is the most accurate statement regarding Jill's situation? A) Jill has no legal recourse since Lena's post was merely an advertisement and not a binding offer. B) Jill can sue for breach of contract since she accepted the offer by beginning to make the mugs. C) Jill might recover under the doctrine of promissory estoppel because she detrimentally relied on Lena's offer. D) Jill's only option is to try to sell the mugs elsewhere since she accepted the risk when she started production.

@NateSilver538 "$100 of inflation" is really meaningless without a benchmark. It's like saying "an hour earlier." Nonsense. It should be in %.

There are some confounders here, but the inflation thing is actually statistically significant! Each additional $100 of inflation in a state since January 2021 predicts a further 1.6 swing against Harris in our polling average vs. the Biden-Trump margin in 2020.
