The EU has tools to pressure member states. Hungary just proved that none of them are strong enough to force compliance.
The European Union launched formal legal action against Hungary over its anti LGBTQ legislation, including infringement proceedings under Article 7 of the EU Treaty and a referral to the European Court of Justice. The Commission also froze billions of euros in EU funding, citing violations of fundamental rights. Seventeen member states publicly condemned Hungary's laws restricting LGBTQ rights.
Hungary's response was to pass even stricter legislation. The April 2025 constitutional amendment went further than any previous measure, enshrining a two sex only definition into the constitution and banning LGBTQ public events entirely. Prime Minister Orbán cited the shift in U.S. policy under the Trump administration as evidence that "the winds have shifted in our favor." Slovakia began drafting a similar constitutional law the same month.
The standoff has exposed the limits of EU enforcement mechanisms and raised fundamental questions about whether the bloc can hold member states accountable when they reject the values the union was founded on.
