“Chilling 999 Call Haunts Judge” - African Refugee Who Raped Woman As She Slept Gets 7 Years A High Court judge in Dublin has described a rape victim's 999 emergency call as "chilling" and unforgettable, during the sentencing of the man who attacked her. The woman was raped by an acquaintance as she slept after leaving a party. The offender, a West African refugee who cannot be named to protect the victim's identity, was convicted by a jury at the Central Criminal Court of raping her in Dublin on 18 December 2021. At the sentence hearing, Ms Justice Karen O'Connor told the victim it was distressing to hear her voice on the 999 recording played during the trial. She noted the man had exploited the woman's "utter vulnerability" while she was asleep and highlighted his "disrespectful" comments about her in a recorded conversation with another man, in which he suggested the other man should also sleep with her. The judge pointed out that the man continues to claim the encounter was consensual and has shown no remorse. Taking into account his personal circumstances, including that he is a father of two who has been in gainful employment, she imposed a seven-year prison sentence, backdated to when he entered custody in March. Justice O'Connor praised the victim for the dignity she showed throughout the difficult trial process and wished her and her family well. She also commended the woman's courage in reporting the crime to gardaí, saying it would encourage other victims to come forward. The woman knew the defendant from living in the same flat complex. On the night of the attack, she attended a birthday party where she drank vodka with cranberry juice and was mildly tipsy. The defendant joined the group as they moved to an "after-party" at a friend's house and ended up in a taxi with her. When they arrived, the woman was upset to find her close male friend wasn't there and only the defendant and another man were present. She went to sleep fully clothed in the bedroom. She later woke to pain and discovered the defendant raping her. In the dark, she fought back forcefully, eventually realising it was him by his hair. She managed to escape the room, confronted the other man, and called 999 while leaving the apartment. The defendant followed her outside but she moved away. She had visible bruises on her arms from resisting. The other man present later testified that she immediately told him she had been raped and appeared very upset. The defendant told gardaí the sex was initiated by the woman and consensual. His defence said he does not accept the jury's verdict. In her victim impact statement, the woman described becoming depressed and withdrawn after the attack. She said she felt betrayed, which has damaged her ability to trust others. She has suffered nightmares, panic attacks, insomnia, and heart palpitations, and has struggled to care for her children or maintain relationships. She found the trial, especially hearing her 999 call replayed, extremely retraumatising. The man originally came from West Africa, lived in Libya, moved to the UK after the fall of Gaddafi, and was later granted refugee status in Ireland.
